AN ORDINANCE AUTHORIZING THE CITY
MANAGER TO ENTER INTO A CONTRACT~
WITHOUT ADVERTISING AND COMPETITIVE
BIDDING~ FOR THE PURCHASE AND IN-
STALLATION OF PHASE I OF AN OUTDOOR
EMERGENCY WARNING SYSTEM FOR THE CITY
OF DUBLIN~ AND DECLARING AN EMERGENCY.
WHEREAS~ Section 8.02(B) of the Dublin Charter enables Council, by
ordinance or resolution adopted by a vote of at least two-thirds of its
members, to authorize, without advertising and competitive bidding,
contracts and expenditures for any purpose where the statutory or common
law of Ohio does not require competitive bidding; and,
WHEREAS~ Section 735.051 of the Ohio Revised Code enables the legislative
authority of a city to authorize, by a two-thirds vote of its members
elected thereto, the City Manager, or other duly authorized contracting
authority, to enter into a purchasing contract without formal bidding and
advertising, when a real and present emergency arises in connection with
the operation of any department, division, commission, bureau or board of
the municipality; and,
WHEREAS, Council perceives that a real and present emergency exists in
that the City is entering "tornado season" without a reliable, effective,
and high quality outdoor emergency warning system to alert its citizens;
and,
WHEREAS~ Council desires to provide a reliable, effective, and high quality
outdoor emergency warning system for the citizens of Dublin as soon as
possible;
NOW, THEREFORE~ BE IT ORDAINED by the Council of the City of Dublin, State
of Ohio, 7 of the elected members concurring:

Section 1. That the City Manager be, and hereby is, authorized to enter
into a contract with the Whelen Engineering Company, Inc. for the purchase
and installation of phase I of an outdoor emergency warning system, with-
out formal bidding and advertising, pursuant to Section 735.051 of the
Ohio Revised Code.
Section 2. That an expenditure not to exceed $150,000.00 for the purchase
and installation of phase I of said outdoor emergency v!arning system be,
and hereby is, authorized.
Section 3. That this Ordinance be, and hereby is, declared to be an
emergency measure necessary for the preservation of the public health,
safety, and welfare and, therefore, this Ordinance shall take effect and
be in force immediately upon its passage.

MEMORANDUM
TO: Members of Dublin City Council

SUBJECT: Purchase of Outdoor Emergency Warning System
DATE: April 3, 1989
Attached for your consideration is Ordinance No. 32-89 authorizing the City
Manager to enter into a contract, without advertising and cOITlpetitive bidding,
for the purchase and installation of phse I of an outdoor emErgency warning
system for a price not to exceed $150,000.00.
With the approach of "tornado season", staff believes it is critical to purchase
the above referenced system as expeditiously as possible. Therefore, staff
requests that formal bidding and advertising requirements be waived, pursuant
to Section 8.02(B) of the Dublin Charter and Section 735.051 of the Ohio
Revised Code.
The vendor (Whelen Engineering Company, Inc.) has agreed to provide phase I
of the above referenced outdoor emergency warning system at prices quoted in a
recent renewal of their 1986 contract with the City of Columbus. Funds for the
purchase and installation of phase I of this outdoor warning system are reflected
in the 1989 Operating Budget.
