Box 370, 6233 Avery Road Dublin, Ohio 43017 July 31, 1990 To: The Honorable Planning and Zoning Commission The Applicants, Avery Road Investments, Inc. , the lessee, and Anderson Concrete Corp., the owner of the property located near the southwest corner of US Route 33/161 and Avery Road, respectfully submit this application for rezoning of the 11.728 acre tract from PUD and GI to Planned Industrial Park. Background. The subject property is currently being leased by Avery Road Investments from Anderson Concrete Corp. Approximately one-half of the property has been developed into a small industrial park consisting of two office- warehouse buildings and a self-storage facility. One building, "Building A", is currently being used for a commercial gymnastics business, Universal Gymnasts Northwest, Inc. The other building, "Building B", is currently being rented to three tenants. The current tenants in Building Bare: LESCO, INC. , a wholesaler of landscape maintenance supplies; Fluid Recycling, Inc. , an on-customer's-site recycler of machining fluids; and Grandma's Fruitcakes, a distributor of gift fruitcakes. The self-storage facility, StorageStar Public Rental Spaces, is being built in phases. The first phase of approximately 35,000 square feet was completed in April 1989. 1 . The second phase will be started in 1991. In addition, Anderson Concrete Corp. operates a concrete batch plant on the remaining part of the parcel. A private sewer treatment plant is located on the parcel serving the two industrial buildings and the self-storage facility. A proposed "Building e" will be located on the parcel containing the sewage treatment facility. A well provides water to these same buildings. Anderson Concrete Corp. also has a well. Building A and Building B are located in a Planned Unit Development District, the sewage treatment facility site and StorageStar are located in a General Industrial District. The Anderson Concrete Corp. plant is in a General Industrial District. Reason for the Rezonin& Request. This request for rezoning is being submitted for the following reasons: 1. Avery Road Investments, Inc. the owner of Building A, Building B, StorageStar Public Rental Spaces and the sewage treatment facility, wishes to purchase the three parcels associated with these facilities from Anderson Concrete Corp. Lot splits for StorageStar and the sewage treatment facility are not currently possible because the parcels associated with these facilities do not front on a public road. 2. Avery Road Investments desires to operate a small U-Haul truck and trailer rental business in connection with StorageStar. This would require modification of the current General Industrial zoning for StorageStar. 2 . 3. Zoning approval will be required for the office-warehouse facility to be constructed on the parcel containing the sewage treatment facility. 4. Approval is required for a post and panel directional sign at the intersection of the private drive in the Planned Industrial Park and Old Avery Road to enable visitors to locate StorageStar, U-Haul and the tenants in the proposed Building C. 5. Under the PUD zoning currently in existence, Universal Gymnasts Northwest, Inc. is prohibited from holding competitive "meets" with more than 3 teams. In this change in zoning from PUD to PIP, it is requested that Universal Gymnasts be permitted to hold meets with up to six teams. 6. The PIP zoning must accommodate a concrete batch plant operation as part of the Planned Industrial Park. This involves changing the current concrete batch plant zoning from GI to PIP. Further, if future expansion of the plant is desired within the area identified for the plant in this application, expansion parameters must be similar to those of the General Industrial District at the time of expansion. Development Plan. The attached drawings show the current development of the 11.728 acre tract, lot sizes within the tract, current and planned building locations and current landscaping of the tract. The uses of Building A, B, and StorageStar are as described above. The proposed Building C will be an office-showroom-distribution facility intended to attract from one 3 to six tenants with businesses similar to the current tenants in Building B. The U-Haul operation will require 10 parking spaces for truck and trailer equipment. The location of this parking area is shown on the development plan. The current three foot mound on the south property line of StorageStar adjacent to the concrete batch plant will be shortened by 220 feet. The mound will be replaced with evergreens planted provide a 75% opacity. No other changes to the StorageStar buildings or parking is required. U-Hau1 rental activities will be conducted in the current StorageStar rental office. One U-Hau1 truck will be parked in the front parking lot of StorageStar. Water, sanitary sewer and surface drainage facilities are in existence and performing properly. These are indicated on the site plot plan attached. Traffic circulation occurs on a private concrete road as shown on the attached plans. The concrete batch plant has been in operation for more than two years. Concrete truck traffic has not interfered with traffic using the other facilities in the site and has not adversely affected the neighbors. Current plans call for commencement of construction of phase 2 of the StorageStar facility in 1991. It is expected that Building C will be constructed in 1991. This will complete the development of the Planned Industrial Park. The subject site is located in a general industrial area south of US Route 33\161. Darby Sales, a retail establishment is located immediately north on Old Avery Road from Building B and directly east of StorageStar. To the south is Warner Construction and Guepel 4 . Construction. To the west is an office-warehouse and storage complex. Across US Route 33/161 is the Riverside Hospital tract. To the east across Avery Road is the Medex property. The uses within this Planned Industrial Park will not conflict with any of the uses surrounding the Park. Further, the uses will not heavily impact the street system, community facilities, services or other public improvements. At some time in the future, the facilities will access the City of Dublin water and sewer lines which are nearby. The 11.728 acre site is owned by Anderson Concrete Corp. who is co- sponsoring the application, indicating approval of the request for rezoning. Avery Road Investments owns the buildings on the site with the exception of the concrete batch plant. Since ownership is restricted to these two parties, there is sufficient control to satisfy Subdivision Regulations regarding control of facilities required for subdivision development. Support for the Request for Rezonin& to Planned Industrial Park. The subject property is currently located in a General Industrial District area. A segment of the property was zoned PUD in 1987 in order to specifically permit and control the activities associated with a gymnastics school in an industrial district. The PUD also upgraded the zoning by restricting outside storage and certain general industrial uses. The PIP zoning requested in this application will further upgrade the zoning classification for the subject property by restricting the activities in additional General Industrial acreage within the property and requiring the owner to apply to the Planning and Zoning Commission 5 . for future changes if desired. Support for each item requested in this rezoning application follows: 1. After examination of all alternatives to splitting the lots, the Planned Industrial Park approach appears to be the appropriate approach. The diverse nature of businesses in this small industrial park makes it desirable to be able to separate StorageStar from the other parcels so that at some time in the future, it will be possible to sell it. Further, the Anderson Concrete batch plant is a totally separate business from the real estate development projects, and should be on a separate parcel. 2. The U-Haul truck and trailer rental business is a natural related business to self-storage. Moving and storage go hand in hand. Although self-storage is often classified as "warehousing", it really is a retail business, selling a storage service. U-Haul truck rental is also a retail business. The U-Haul operation will not adversely affect the neighborhood since the truck parking area will be hidden by buildings and a six foot mound along US Route 33/161 and an row of evergreen trees along the south adjacent to the concrete batch plant at the rear of the property. 3. The last undeveloped parcel in this industrial park will be developed with a building similar to buildings A and B and will be compatible in use. It is appropriate to establish zoning for this parcel now so that the completed industrial park can be evaluated by the Planning and Zoning Commission. 4. Since there will be several diverse businesses within the park it will be necessary to provide a directional sign at the entrance of 6 the private road to assist visitors to locate the businesses. 5. Universal Gymnasts' past invitational meet activities have been monitored regularly by the Dublin Planning Department. There have been no problems associated with the meets regarding excessive traffic, parking or interferences with other business in the immediate vicinity. The owner of Universal Gymnasts Northwest wishes to expand the competitive teams invited for invitational meets from three teams to six teams. She would like to schedule eleven meets during the fall and winter months. All the meets will occur on weekends or holidays. The number of competitors per meet will range from twenty to sixty-five. The number of cars at the meets will range from ten to thirty. There are sixty-one parking places associated with Buildings A and B. All of these would be available for the meet competitors' cars during scheduled events. 6. Since the concrete batch plant is currently approved as a General Industrial District use, and since the batch plant operation has not adversely affected the other businesses within the industrial park or the neighborhood, it is desired that this approval be extended as an approved use within the Planned Industrial Park. Further, Anderson Concrete wants the right to expand, modernize and winterize this plant at some time in the future. If approval for the expansion is required of the Planning and Zoning Commission, Anderson Concrete would like to have the same parameters applied to such expansion as exist in the General Industrial District, and if the parameters are met, an assurance that the expansion will be approved. Anderson does not require additional acreage for the expansion than that shown on the development plan 7 ~ submitted herein. Rezoning Application Z90-006 - Avery Road Investment Ms. Clarke presented the Staff Report and slides of the site. This application involves 11.728 acres located on the west side of Old Avery Road south of U.S. 33/S.R. 161. The property has been developed with two office-warehouse buildings (zoned PUD, Planned Unit Development District), a self-storage facility (Storage Star) and a small sewage treatment facility (zoned GI, General Industrial). The remainder of the site includes the Anderson Concrete Corporation's batch plant, zoned GI. Immediately north of the site is Darby Sales, a retail establishment. To the west is property located within Washington Township zoned LI, which is currently in the annexation process to Dublin, ana south of the site are other construction uses zoned GI. The request is to rezone the property from GI and PUD to PIP, Planned Industrial Park District. An informal review of this application was heard by the Planning and Zoning Commission at the August 9, 1990 meeting. This rezoning will provide for lot splits for the self-storage facility (Storage Star) and the sewage treatment facility. This is not currently possible because the resulting parcels do not have 100 feet of frontage on a public road. Other changes on the site with the rezoning include the development of an office-warehouse facility on the sewage treatment facility site, the addition of a small U-Haul truck and trailer rental business, and the request to allow Universal Gymnasts to hold additional competitive meets. There is a 32-foot concrete drive which provides access from Old Avery Road to the Anderson Concrete site. The applicant had met with Staff to address the deficiencies listed in the Staff Report, and Staff is satisfied that the application is complete. Mr. Geese asked Ms. Clarke if there was a need for additional comments since it appears that everything has been submitted. Ms. Clarke said no. There were no comments from the Commission. Mr. Geese asked Mr. Weil if he had any additional comments. Mr. Weil said he met earlier in the week with Steve Mack regarding some engineering concerns. Mr. Weil said the drainage plan for the undeveloped site will be submitted prior to developing that site. He also said that the rezoning should not affect the operation of the concrete batch plant either as it currently exists or as it may be expanded in the future. He also said that the parameters that currently exist under the General Industrial zoning be applied to any expansion or modification of the concrete batch plant under the new PIP plan. Mr. Campbell asked Mr. Banchefsky if this can be done in the future. Mr. Banchefsky said yes. Ms. Clarke suggested to Mr. Weil that since Anderson Concrete is concerned with this issue, that two sentences be rewritten in the text which would make this completely clear. Ms. Clarke said that there is a future issue with regard to this site and the Thoroughfare Plan. The plan calls for a freeway loop to be constructed at this location. The area which needs to be acquired has already been developed. The back part of the site, which is still available for development will not likely be needed for freeway improvements. The preliminary engineering for this area is in process. Mr. Leffler asked if the text for PIP was received. Ms. Clarke said it was . Mr. Campbell motioned to approve the application subject to the amendment of the text to provide that this application would not adversely affect Anderson Concrete from its present usage of the premises nor any possible expanded usage of the premises so long as that future expanded use would be consistent with the use that is presently granted for the premises.
