AN ORDINANCE AUTHORIZING PAYMENT
TO FRED S. FABER AS PAYMENT FOR
SERVICES IN CONNECTION WITH
COMMERCIAL PLANS EXAMINER AND
CHIEF BUILDING OFFICIAL, AND
DECLARING AN EMERGENCY
WHEREAS, the City of Dublin has previously contracted with Frederick S.
Faber as president of Faber-Ireland Design Associates, Inc. for plans
examiner and chief building official services; and,
WHEREAS, this contract was subsequently terminated; and,
WHEREAS, the amount due and owing by the City has been disputed and as
a result thereof litigation and/or arbitration has been threatened; and,
WHEREAS, it is Council's desire to resolve this matter without the need
for litigation and/or arbitration by compensating Frederick S. Faber for
services and expenses incurred; and,
WHEREAS, Frederick S. Faber and the City of Dublin have reached an agree-
ment acceptable to both parties as to the amount of compensation to be
paid.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin,
State of Ohio, 5 of the elected members concurring that:

Sect ion 1. This Council hereby authorizes payment to Frederick S. Faber
in the amount of Twenty Thousand Dollars ($20,000.00).
Section 2. This payment shall be contingent upon Frederick S. Faber
providing the City with a release of any and all claims both for
himself and any and all corporate entities who may have a claim relating
to the aforementioned services. Such release to be acceptable to the
City Law Director.
Section 3. This Ordinance is declared to be an emergency necessary for
the immediate preservation of the public health, safety and welfare
and shall take effect and be in force immediately upon passage in order
to avoid the cost and risk to the City which is inherent in any litigation
and/or arbitration.
