Ordmance NO'mmmn.. ------------- AN ORDINANCE SETTING FORTH STANDARDS AND CRITERIA FOR CONVERSION OF PRIVATE STREETS TO PUBLIC STREETS WHEREAS~ the construction, subdivision and zoning standards within the City of Dublin have changed affecting street specifications, location, etc. ; and WHEREAS~ there have been increased requests for acceptance by the City of private streets as public streets; and WHEREAS, the conversion of private streets to public streets directly affects public health, safety and welfare issues such as street maintenance and repair, snow and ice removal and garbage collection; and WHEREAS~ as a result thereof, the Public Service Committee has developed standards to regulate and control the conversion of private streets to public streets. NOW~ THEREFORE~ BE IT ORDAINED by the Council of the the City of Dublin, State of Ohio, ~of the elected members concurring that: Section 1. Chapter 913.13 is hereby amended to include the following: 913 .02 DEFINITIONS Unless the context specifically indicates otherwise, the meaning of the terms used in this Chapter shall be as follows: (a) "Street" means a road which provides access to three (3) land parcels in its first three hundred (300) feet~ or which provides access to ten (10) land parcels throughout its total length or which the community desires to serve as a connecting link between two (2) existing streets. (b) "Roadway" means the entire width of the right- of-way and all street elements (i.e. - pave- ment~ curbs/gutters~ ditches~ sidewalks, conveyances, stormwater drainage and etc.) that are contained within the right-of-way. 913 .03 PRIVATE STREET CATEGORIES Criteria for the acceptance of private streets as public streets shall be divided into three (3) categories as follows: (a) A platted but unbuilt private street (1) For acceptance as a public street~ the private street must meet all of the Dublin Zoning~ Subdivision and Engineering standards which are in affect at the time of the request. The standards include but are not limited to the following: Right-of-Way Width Street Width Curb and Gutter Roadway Typical Section Pavement Thickness and Strength Building Setback Sidewalk Installation and Placement RECORD OF ORDINANCES Dayton Legal Blank Co. (1) For acceptance as a public street~ the private street generally must meet those standards noted above. It wi 11 be reeognized~ however, that through the area(s) where development has already occurred~ certain of these standards cannot realistically be met. As a minimum the following standards must be met through those areas in whieh development already exists. Street Width Curb and Gutter Pavement Thickness and Strength Sidewalk Installation (c) Street built and all (or nearly all) abutting parcels developed. (1) For acceptance as a public street~ it is required that the public street generally meet these standards for an unbuilt street which are noted above. It is recognized, however, that certain of these standards cannot realistically be met. As a minimum for acceptance as a public street~ the following standards must be met: Street Width Curb and Gutter Pavement Thickness and Strength Sidewalk Installation provided that this Ordinance shall not apply to applications pending on the date of passage of the ordinance. 913 .04 PROCEDURE (a) An applicant seeking conversion of a private street to a public street shall first consult with the City Planning and Engineering Staff. (b) The applieant shall then submit a written application upon a form acceptable to the City Planning and Engineering Staff for staff's review and recommendation to the Planning and Zoning Commission. (c) Upon approval of the Planning and Zoning Commission, said Commission shall certify one (1) copy of the approved application and meeting minutes to Council for approval or disapproval. (d) In the event of a disapproval recommendation by the Planning and Zoning Commission, the applicant may submit this matter for review by City Council. However~ a two-thirds vote of Council shall be necessary to override the recommendation of the Planning and Zoning Commission. (e) The decision of Council as to approval or disapproval of the request for private to public street conversion shall be final. RECORD OF ORDINANCES Dayton Legal Blank Co.
