AN ORDINANCE AUTHORIZING PAYMENT
TO RUTH E. MAST AS AND FOR
COMPENSATION FOR ROADWAY RIGHT-
OF-WAY APPROPRIATED BY THE CITY
OF DUBLIN, ALONG THE WEST SIDE OF
AVERY ROAD, AND DECLARING AN

WHEREAS, the City of Dublin has previously appropriated property along
the west side of Avery Road, belonging to Ruth E. Mast, pursuant to
the provisions of the Ohio Constitution, Ohio Revised Code and Dublin
City Charter; and,
WHEREAS, pursuant thereto, the City initiated litigation in the Franklin
County Common Pleas Court; and,
WHEREAS, Council has previously authorized the law director to settle
the aforementioned litigation pursuant to terms and provisions set
forth herein; and,
WHEREAS, it is Council's desire to take official action so as to approve
the terms and provisions of the aforementioned settlement.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State
of Ohio, 6 elected members concurring that:
Section 1. The settlement proposal previously approved by Council,
authorizing payment to Ruth E. Mast in the amount of One Hundred Nine
Thousand Dollars ($109,000.00) along with conveyance to her of .436
acres of City owned property in consideration of her conveyance to the
City of .688 acres of right-of-way along with a temporary and construction
easement, is hereby fully approved.
Section 2. The City Law Director and Finance Director are hereby authorized
to take the necessary steps to finalize this transaction.
Section 3. Based upon the need to commence and continue the Avery Road
improvement project, this Ordinance is declared to be an emergency
necessary for the immediate preservation of the public health, safety
and welfare and shall take effect and be in force immediately upon
passage.
