AN ORDINANCE AUTHORIZING PAYMENT
TO HERBERT W. AND LEONA M. JONES
FOR THE PURCHASE OF THE PORTION
OF LOT 108 LOCATED EAST OF LOWER
STREET AND BETWEEN LOWER STREET
AND THE WEST BANK OF THE SCIOTO
RIVER
WHEREAS, the City has previously created and developed a passive park known
as Dublin Spring Park located east of Lower Street and between Lower
Street and the west bank of the Scioto River; and,
WHEREAS, litigation was subsequently initiated by the owners of Lots 106
and 107 as to their ownership rights relating to the aforementioned park
property; and,
WHEREAS, the City has previously settled these lawsuits by compensating
the Plaintiffs therein for their interests in said park property; and,
WHEREAS, Herbert W. Jones and Leona M. Jones are similarly situated
property owners claiming an ownership interest in part of the land
upon which said park is located; and,
WHEREAS, it is Council's desire to avoid the need for further litigation
by compensating Herbert W. Jones and Leona M. Jones in the manner
consistent with the settlements approved as to the other similarly
situated property owners.
NOW, THEREFORE BE IT ORDAINED by the Council of the City of Dublin, State
of Ohio, 6 members concurring that:
Section 1. In exchange for Herbert W. Jones and Leona M. Jones conveying
that portion of Lot 108 located east of Lower Street and between Lower
Street and the west bank of the Scioto River to the City of Dublin as
and for a passive park, this Council hereby authorizes payment to them in
the amount of Twenty-Five Thousand Dollars ($25,000.00).
Section 2. This Ordinance shall take effect and be in force from and
after the earliest period allowed by law.
