This application was tabled at the April 4, 1991 meeting of the Planning and Zoning Commission. The applicant accepted five of the six conditions in this report at that time, but he felt the right-of-way dedication was not a commitment he could make. He is now in agreement with all six conditions. As there have been no changes to the rezoning application or the plan, no new materials have been included in the packet. B. The site contains 4..4 acres to the centerline of the road and is located on the west side of Avery Road between Shier-Rings Road and Dan-Sherri Drive, just across from Irelan Place. The property was included in a major annexation to Dublin from Washington Township which went into effect last fall. The site contains a white, ranch-style, single-family house on the southern portion which is being used for office uses with a parking area in the front and rear. The Cosgray Ditch runs through the northern section of the site. Washington Township rezoned the land to the RI, Restricted Industrial District prior to annexation, and until Dublin establishes its own zoning upon the land, the rights and restrictions of the Washington Township RI zone will continue to be applied. To the north is a CC, Community Commercial District that is developed with a house, an Ashland Chemical facility and Dublin Building Systems. Across Avery Road is a mix of office and warehouse or light industrial uses on Irelan Place with RI (Wa. Twp.l zoning. To the south is a furniture stripping operation and to the west is the Dublin maintenance and school bus complex. C. The applicant is requesting to rezone the parcel into two Dublin districts. He would like to have three one-half acre sites along Avery Road for small office uses, and SO, Suburban Office and Institutional District is requested. To the rear, through an access corridor between two of the office lots, is a 2,7 acre parcel that is being planned for industrial development, and the Dublin RI, Restricted Industrial District is being sought, 5131 Post Rd. The Proposed Southwest Area Plan was prepared last year, and while it covered a lot of the new southwestern section of Dublin, it did not include any of the land to the west of Avery Road. However, the plan identifies light industrial and office uses for much of the east side of Avery Road. The Dublin Community Plan sets forth the major street system, and Avery Road is shown at a proposed right-of-way width of 112 feet. Traffic on Avery Road is expected to escalate sharply as its importance as a part of the Dublin arterial system increases. At some point in the future, Avery Road will need to be totally rebuilt as a major road. E. The office sites are quite small, and the applicant is aware of the yard requirements applicable to all of the sites. This is essentially a down zoning (from industrial to office) for the frontage and an administrative housekeeping matter for the industrial land, The Staff expects that a program, perhaps by use of another overlay district, for the coordinated development of the Avery Road frontage will be in place in the not too distance future. In the meantime, Staff feels this proposal is reasonable, even preferable, and supports the application. Staff is recommending approval subject to: 1 ) Dedication of right-of-way consistent with the Community Plan (56 feet from centerline) ; 2) Limitation of two curb cuts to serve the entire site; 3) Drainage detention to meet MORPC guidelines and be approved by the City Engineer. It is zoned RI, Restricted Industrial (Washington Township zoning prior to annexation) . This application was discussed last month and the applicant accepted the staff report conditions with the exception of dedication of right-of-way. Mr. Weil now is in agreement with this issue. There have been no other changes and no new plans. Mr. Bowman said there is still much study to be done with Avery Road. The existing structures will have to be examined to see how they are affected by the 56' of right-of-way. If it is found that there are too many structures and the road should be designed in a different manner, the unnecessary portions will be deeded back. Rezoning Application Z91-003 - Sivad Investment Company - 6363 Riverside Drive Ms. Clarke showed slides and presented the staff report. She said there is a single-family house on the 0.38-acre site on Riverside Drive. It backs up to a parcel which the City of Columbus owns and is rented by Dublin as a public park. The rear yard which has been mowed with this house is actually owned by the City of Columbus. This application was tabled in May, and there have been several changes. The proposed use and architecture will be the same, but there are changes in the site plan. The driveway has been moved to the south property line, and the applicant is seeking one of two development plans. The front acreage is zoned CC, Community Commercial and the back piece, which is a 50-foot strip (owned by Columbus), is zoned R-4 and is .16 acre. The applicant proposes to rezone his property to the PUD, Planned Unit Development District, and to build a 3,200 square foot office building. He would like to create parking and public access to Riverfront Park from the 50-foot strip to the rear of his building. If he is not able to come to terms with the City of Columbus, he would like to install 11 parking spaces. This will have to be finalized before this application is referred to City Council. The PUD District is requested in this combined concept and preliminary development plan. When the building is built, he will come back with a Final Development Plan. Since the site is extremely small, there are several variances contained within this plan; to reduce front setback from 112 feet from centerline to 70 feet. The parking setback is to be reduced from 90 feet from centerline to 75 feet. Staff feels this is a downzoning of the property from Community Commercial to a planned office district. The mound to the rear of the site is on the City's property at the maintenance facility. Washington Township rezoned the land to the RI, Restricted Industrial District prior to annexation, and until Dublin establishes its own zoning upon the land, the rights and restrictions of the Washington Township RI zone will continue to be applied. The applicant is requesting to rezone the parcel into two Dublin districts. He would like to have three one-half acre sites along Avery Road for small office uses, and SO, Suburban Office and Institutional District is required. The remainder will be Dublin's RI District. Mr. Lou Weil, representative of the applicant, said the single-family house located on the property currently has seven offices. He said this application was initiated by a potential sale to an insurance agent because Rl was not the right zoning for the office complex. It is the applicant's intention to develop the front acres into office buildings and the back acres into office showroom or warehouse uses. He said the Staff report was reviewed with the prospective buyer today. The Staff comment which requires the applicant to dedicate the full 56-foot right-of-way which is stipulated in the Dublin Thoroughfare Plan will create an undue hardship for the buyer. The applicant is willing to dedicate 30-feet, which is the normal right-of-way for the road. Mr. Weil stated that it is likely that the majority of homeowners along Avery Road will be compensated for that right-of-way when the City decides to widen Avery Road. He said he is downzoning this property which is currently zoned Restricted Industrial (improving the zoning) but is being asked to pay a price for it. Mr. Willis said the buyer feels compensation is due for the area greater than 30 feet, but is not questioning the validity of the larger right-of-way. He said the property owner is using this street for access and development purposes and is saving some money by not having to build a new road to service the development. He said this right-of-way must be dedicated. Mr. Weil asked that this application be tabled in order to talk with the buyer and then come back before the Commission next month. He feels the comments made tonight will be helpful to the buyer in making his decision. Mr. Leffler asked what the dedication is for the offices across the road. Mr. Bowman said much of this was completed in the Township before it came into Dublin. He said a study will be completed in the next year of Avery Road for land use and transportation purposes and to verify if the dedication requirement for an arterial of 112 feet of right-of-way is needed. The Ordinances also require that the proposed right-of-way width be used to establish the setback. Mr. Campbell made a motion to table this application until the May meeting. Mr. Manus seconded the motion and the vote was as follows: Mr. Fishman, yes; Mr. Geese, yes; Ms. Stillwell, yes; Mr. Leffler, yes; Mr. Kr~nstuber, yes; Mr. Manus, yes; and Mr. Campbell, yes. Rezoning Application Z91-00 1 - COT A Park and Ride on Sawmill Road Ms. Clarke said the applicant has submitted final landscape drawings, etc., and this is a request for a combined rezoning and development plan review. If this application is approved, as it is requested, it will be for both a recommendation to Council on the rezoning for a Park and Ride and for the confirmation of this plan as submitted. The applicant's text explains the other sites which were considered, the contacts with other property owners, and how this site meets COTA's objectives. The application fits into the scheme of the Community Plan with the dedication of right-of-way along Sawmill Road, and installation of a five-foot sidewalk along the frontage of Sawmill Road and installation of a metal and brick decorative fence similar to the treatment in Dublin Village Center. The East Dublin Civic Association recommended that the Park and Ride be built either at the Schottenstein site or at the Solove shopping center in Columbus. The Schottenstein organization said it will cooperate provided: 1) It is Dublin's goal to have a Park and Ride established at Sawmill and Hard Road and 2) An appropriate plan can be worked out. Their time frame is not 1991. They expect to extend utilities this year, and the earliest possible time for construction along Sawmill Road north of Hard Road would be sometime late 1992 or 1993.
