AN ORDINANCE PROHIBITING
THE SCAVENGING OF REFUSE,
GARBAGE, RUBBISH, RE-
CYCLABLE MATERIALS, OR
YARD WASTE WITHIN THE
CITY OF DUBLIN
WHEREAS, the City of Dublin has entered into a contract with a private
contractor for the collection of residential refuse, garbage, rubbish,
recyclable materials, and yard waste; and,
WHEREAS, the City has given the contractor the right to collect and
dispose of such refuse, garbage, rubbish, recyclable materials, and
yard waste; and,
WHEREAS, the City intends to protect these rights by preventing the
scavenging of such refuse, garbage, rubbish, recyclable materials,
and yard waste by enacting legislation to prohibit such scavenging.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin,
State of Ohio, ~of the elected members concurring that:
Section 1. No person shall remove, overturn, or tamper with any refuse,
garbage, rubbish, recyclable materials, yard waste, or the container
therefor when such refuse, garbage, rubbish, recyclable materials,
yard waste, or container is set out on a public street or highway,
sidewalk, alley, or on private premises, and when such refuse, garbage,
rubbish, recyclable materials, yard waste, or container is placed there
for the purpose of collection. This provision shall not apply to any
employee of the City of Dublin or to any federal, state, or local law
enforcement authorities who are involved in any investigative activities,
or to a private person or organization authorized to remove such refuse,
garbage, rubbish, recyclable materials, yard waste, or container.
Section 2. Whoever violates the provisions of this Ordinance is guilty
of a minor misdemeanor on the first offense; on each subsequent offense,
such person is guilty of a misdemeanor in the fourth degree.

Section 3. This Ordinance shall take effect and be in force from and I
after the earliest period allowed by law.
