AN ORDINANCE AUTHORIZING
ACQUISITION OF FEE SIMPLE
INTEREST IN A 2.3779 ACRE
TRACT OF REAL ESTATE; AP-
PROPRIATING FUNDS THERE-
FORE; AND DECLARING AN
EMERGENCY
WHEREAS, the City is preparing to construct a new bridge over the
Scioto River; and,
WHEREAS~ said improvements will require the City's obtaining fee simple
ownership in a 2.3779 acre tract of land located at 6950 Dublin Road;
and,
WHEREAS~ passage of this Ordinance as an emergency is necessary so as
to minimize the disruption to the present property owners.
NOW, THEREFORE~ BE IT ORDAINED by the Council for the City of Dublin,
State of Ohio ~members concurring that:
Section 1. The Law Director is directed to purchase the 2.3779 acre
tract of real estate also known as 6950 Dublin Road, and more fully
described in Exhibit "A", attached hereto, for the purpose of providing
access to the new Scioto River bridge.
; ~. Section 2. The consideration to be paid for the property is Three
: 8 Hundred Five Thousand Dollars ($305,000.00), upon execution and
~ 1; delivery to the City of Dublin of a warranty deed accompanied by
~ '~ title guarantee conveying the premises to the City of Dublin, in fee
:~~ simple, free and clear from all encumbrances excepting conditions and
j~ :~ restrictions of record, zoning ordinances and taxes and assessments
~ levied and assessed subsequent to the date of conveyance. The City

~ Law Director is also directed to include within the purchase contract,
~ provisions for payment of the current owners out-of-pocket moving
'ci ~ expenses as well as provisions allowing the current property owners I.
g ~ to remain in possession of said property for at least six (6) months
~ 'B \ after the acquisition of title by the City with an option to lease the I
o ~ ~ property at minimal consideration until such time as the City is I
~ ~ prepared to actually initiate site preparation/demolition. .1

.~ ~ Section 3. The purchase price, together with any cost or expense incurredl
S~ by the City in connection with the acquisition including closing costs, II
] g relocation costs, etc. is hereby appropriated from the unappropriated !
~,5 balance of the Capital Improvement Tax Fund for the purpose of paying
t ~ all of the aforementioned costs and expenses.

if~ Section 4. The City Manager is hereby authorized to execute a real
j ~ estate purchase contract and any other necessary closing documents
- 0 related to this acquisition.
Section 5. This Ordinance is hereby declared to be an emergency necessarY'l'
for the immediate preservation of the public health, safety, and welfare .
and shall take effect and be in force immediately upon passage. The I
I
emergency nature of this Ordinance is due to Council's policy of i
acquiring property necessary for capital improvements in as timely manner
as possible and to minimize disruption to property owners who are dis-
located as a result thereof.

The subject property is situated in the Scioto Shores Subdivision, Washington
Township, Dublin, Ohio in the southern portion of the City and the neighborhood
is bounded by Riverside Drive to the east~ Dublin-Granville Road to the south~
., Coffman Road to the west and the Delaware County line to the north.
The subject property has river frontage along the Seioto River.
The housing along the river ranges in age from new eonstruction to 100 years old
with many unique custom price range homes. Observation of the area indicated
pride of ownership is at a high level with properties adjacent to the river.
The price range of housing in the area ranges from approximately $140,000.00 to

Dublin/Washington Township is adjacent to and suburban to Columbus~ Ohio, and
transportation to other parts of the metropolitan area is good. There is a bus
line serving the Dublin area and for those traveling by automobile, aeeess to
