Ordinance Na. 10-91 Passed 19~ u~l_._ I AN ORDINANCE AUTHORIZING THE \ PURCHASE OF SERVICES TO REPAIR A BROKEN STORM SEWER WITHOUT FORMAL ADVERTISING AND COMPETITIVE I' BIDDING, AND DECLARING AN EMERGENCY WHEREAS, on Friday, January 11, 1991, a collapse of a storm sewer on Post Road at Wilcox Road required that Post Road be closed until repairs could be made; and, WHEREAS, it was imperative to repair the storm sewer immediately in order to open Post Road to through traffic and minimize the disruption of emergency services to the surrounding area; and, WHEREAS, it was necessary to purchase materials and contractual services in excess of the $10,000.00 bid limit, on an emergency basis; and WHEREAS~ Section 735.051 of the Ohio Revised Code enables the legislative authority of a City to authorize, by two-thirds vote of its members elected thereto, the City Manager, or other authorized contracting authority, to enter into a purchasing contract without formal bidding and advertising, \' when a real and present emergency arises in connection with the operation of any department, division, commission, bureau, or board of the municipality. I NOW~ THEREFORE~ BE IT ORDAINED by the Council of the City of Dublin, State l of Ohio, 7 of the elected members concurring: Section 1. That Ordinance No. 128-90, the temporary appropriations ordinanc be amended by appropriating from the unappropriated balance in the Street Maintenance Fund the sum of $15,100.00 for operating supplies. Section 2. That pursuant to Section 735.051 of the Ohio Revised Code, the purchase of emergency repair services from Shepherd Excavating without for- mal advertising and competitive bidding in the amount of $14,500.00 is hereby authorized. Section 3. That this Ordinance be, and hereby is, declared to be an emergency measure necessary for the preservation of the public health, safety and welfare and, therefore, this Ordinance shall take effect and be in force immediately upon its passage. Johnson, Maintenance superintendent~~ Re: Post Road Storm Sewer Collapse Date: January 14, 1991 On Friday, January 11, 1991 at approximately 11:30 AM the Maintenance Division received a call to investigate a storm sewer at Post and Wilcox. While inspecting the pipe a maintenance worker crawled into the pipe and discovered a large cavity under the road. The employee then called for me to meet him at the site. As soon as I arrived at the scene I ordered the road closed. I then called Shepherd Excavating and explained the situation to them and told them I needed to get the road re-opened as soon as possible and the we would not stop working on the repairs until the road could be re-opened. Within and hour and a half Shepherd Excavating had arrived on the scene with the necessary equipment and pipe and the repairs were begun. I had predicted the road would be re-opened at about midnight. However, at 10:30 PM we were approximately half way across the road and had the ditch open when a cave-in occurred. It took about 2 hours to re-open the ditch as we had to hand dig around 2 phone lines. The cave-in and delays in getting concrete cause the opening of the road to be delayed until 4:30 Saturday morning. At this point, there are still steel plates across the road. It will be approximately 2 weeks before the plates can be removed. This delay is due to the weather and to the lack of availability of blacktop. The repairs of the road were conducted on an emergency basis. The exact cost of the repairs are not know at this time, but Shepherd Excavating has estimated the cost at $14,500.00. There were several reasons why the situation was treated as an emergency. First, Post Road is a major through road which is heavily used by emergency equipment (police and fire) . Also, the traffic problems for the general public were taken into consideration. Second, the fact the road would have had to remain closed until Monday was considered. Third, the contractor's original estimate was that the work could be completed in 6 hours (not the 14 1/2 it ended up) . Also, the Maintenance Office did receive several phone calls from irate citizens on Friday. One lady was so upset she threatened to move the barricades herself. I . . For all these reasons I made the decision to treat the situation as an emergency. I am requesting that Council appropriate $15,100 as emergency funds to cover the costs of the repairs. This figure represents the $14,500.00 estimate from Shepherd and also a $600.00 estimate for heat welding the pavement. DLJ/tb
