AN ORDINANCE TO ACCEPT THE
LOWEST/BEST BID TO OPEN,
CONSTRUCT AND IMPROVE A
PUBLIC STREET IN THE CITY
OF DUBLIN - THE MUIRFIELD
DRIVE CONNECTION, AND DE-
CLARING AN EMERGENCY
WHEREAS, after advertising and receiving bids and opening said bids on
November 30, 1990, for the Muirfield Drive connection; and
WHEREAS, Council has determined that the lowest and best bid for said
project is from Nickolas Savko & Sons, Inc. in the amount of
$1,306,808.55.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin,
State of Ohio, 5 of the elected members concurring:
Section 1. That the bid from Nickolas Savko & Sons, Inc. in the amount
of $1,306,808.55 be, and hereby is, accepted.
Section 2. That the City Manager and Finance Director be, and hereby
are, authorized and directed to execute a contract with Nickolas Savko
I & Sons, Inc. for completion of said project pursuant to the bid
I specifications and documents on file in the office of the City Engineer
Section 3. That this Ordinance be, and the same hereby is, declared to
be an emergency measure for the preservation of the public peace,
health or welfare of this City and for the further reason that this
Ordinance is required to be immediately effective to provide for the
construction of the improvement, which is needed to reduce traffic
congestion and enhance traffic safety in the City, and therefore this
Ordinance shall take effect and be in force immediately upon its
passage.

Report From City Engineer
As Counc il is aware, the timely completion of the Muirfield Drive Connection
is an important community goal. In this regard, nine bids were opened on
November 30, 1990 for the Muirfield Drive Connector construction project.
Those bids are shown on the attached bid summary and range from $1,307,808.55
to $1,942,875.45.
I. The lowest bid was submitted by Nickolas M. Savko & Sons. This bid is
not considered to be the best bid because:
- This company has a recent history in Dublin of not completing
projects on time, and this history is repeating itself on a
present project. The present Blazer Connector project work is
behind the company's own original construction schedule. In
fact, the company recently revised that schedule. A copy of
the original and revised construction schedules is attached.
- The Frantz Road widening project was completed almost seven
months late. It was, however, essentially completed this past
summer except for minor punch list items. We have been trying
since then to get the Savko organization to complete minor
punch list items on the project. Within the past two weeks,
those items were reported complete and are now being verified.
- The Savko bid is an unbalanced bid. The primary bid, on this
project, is for a stone base pavement typical section, and the
alternate bid is for a concrete base typical section. Though
considered equal in strength and longevity, concrete base
pavement is more expensive. The Savko bid is unbalanced by
making the concrete base cost less than the stone base cost.
The fact that stone base pavement is less expensive then
concrete base pavement is supported by all other bids
received.

The Savko bid has unbalanced the Primary and Alternate bids to
give a bias toward a concrete base typical section. Section
102.03 (c) of the Construction and Materials Specifications
states that a bid may be refused or not considered because of
an obvious unbalance in that bid. A copy of that portion of the
Construction and Material Specifications is attached.
- This Company has been awarded the contract for the 1991 Parade
of Homes. Because the Parade of Homes project will likely
require significant resources, this Company's ability to
complete both projects in a timely manner is questioned.
II. Morris Excavating Co. submitted the second lowest bid. We have
little experience with this company and therefore must depend upon
the experiences of other organizations who have utilized their
services.

attached.

Their bonding company reports their bonding to be $4,000,000 per
project with a total aggregate of $10,000,000 for all projects.
The timely completion of the Muirfield Drive Connector is very important
to the community. We believe the the Morris Excavating Co. has the
ability and capacity to complete the project on time. Therefore, It is
recommended that Council authorize the City Manager to enter into a
contract with Morris Excavating Co. in the amount of $1,318,076.50 for
construction of the Muirfield Drive Connector with a stone base typical
section.
