AN ORDINANCE TO RAISE THE I

SPEED LIMIT ON ALL OF AVERY I
ROAD WHICH LIES SOUTH OF I
VALLEY STREAM DRIVE

WHEREAS, at present, the speed limit on Avery Road is 35 MPH, established
by ORC 4511.21, that road being an extension of a through highway within
the municipal corporation and outside of its business district; and
WHEREAS, ORC Section 4511.21 (K) does enable the local authority to
adopt, by ordinance, a higher speed limit on non-state highways; and
WHEREAS, by ORC, this adopted higher speed limit cannot exceed the
lower of that which is established in 4511.21 (A) (reasonable and
proper, stop within assured clear distance) or 50 MPH.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin,
State of Ohio, 7 of the elected members concurring:
Section 1. That the speed limit on all of Avery Road which lies south
of Valley Stream Drive be raised to 45 MPH when that portion of Avery
Road is opened.
Section 2. That the City Manager is authorized to lower these speed
limits based upon changes in traffic volume, type/number of accidents,
amount of development, number of intersections and other such factors.
Section 4. That this Ordinance shall take effect and be in force from
and after the earliest period allowed by law.
