Form No. 30043 Ordinance No. 42-90 Passed ______.19 - - - - - - -- --~- - --.. ~- ----- ---------- ---- AN ORDINANCE AMENDING ORDINANCE NO. 06-90, THE ANNUAL APPROPRIA- TIONS ORDINANCE AND ORDINANCE NO. 31-90 AUTHORIZING THE PURCHASE OF A SEWER VACUUM MACHINE WITHOUT FORMAL BIDDING, AND DECLARING AN EMERGENCY WHEREAS, the Ohio Revised Code requires, when necessary, amendments to the Appropriations Ordinance in order that appropriations are not overexpended and, WHEREAS, it is necessary to appropriate additional funds for the retire- ment of outstanding debt and the purchase of a sewer vacuum machine and attachments; and, WHEREAS, it is necessary to amend the ordinance authorizing the purchase of said sewer vacuum equipment; NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, 7 of the elected members concurring: - Section 1. That there be appropriated from the unappropriated balance in the Capital Improvement Tax Fund to account D10-07-7A-250I the sum of $56,630.00 for the balance needed to purchase a sewer vacuum machine and attachments. Section 2. That Ordinance No. 31-90 be amended to allow for the purchase of attachments in the amount of $14,630.00 (without formal advertising or competitive bidding) for a total amount of $146,630.00. Section 3. That there be appropriated from the unappropriated balance in the General Obligation Debt Service Fund the sum of $7,451,417.00 to the following accounts: C01-03-3B-2610 $1,140,000.00 C01-05-5A-2610 3,599,167.00 C01-06-6A-2610 432,250.00 C01-07-7E-2610 2,280,000.00 said increases to be offset by the sale of notes in the amount of $7,805,000.00. Sectionn 4. That there be transferred from account E01-05-5W-2560 to account E01-05-5T-2710 the sum of $76,210.00 for subsequent transfer to the General Obligation Debt Service Fund to pay interest on outstanding debt for water system improvements. Section 4. That this Ordinance be, and hereby is, declared to be an I emergency measure necessary for the preservation of the public health, safety, and welfare and, therefore, this Ordinance shall take effect and be in force immediately upon its passage. Hansley SUBJECT: Ordinance No. 42-90 DATE: April 10, 1990 Report initiated by Nanette J. Metz, Finance Director I am requesting that this Ordinance be passed as emergency legislation for the following reasons: 1. The sewer vacuum machine has already been ordered at $132,000.00. The attachments were obtained from a separate vendor in the amount of $14,630.00 for a total of $146,630.00. The original ordinance stipulated "an amount not to exceed $140,000.00". In addition, the attachments exceed the bid limit of $10,000.00 so formal bidding needs to be waived. 2. The notes to be retired have already matured on AprilS, 1990. The amended appropriations need to be made after the new notes are sold, which also took place on AprilS, 1990. In order to prevent these accounts from appearing to be overdrawn, this needs to be passed as an emergency. NJM:fmu
