Form No. 30043 Ordinance No, .40__90, 'un' Passed.,., u",_.' ..,,_"n'.'__U' ".,19, AN ORDINANCE AUTHORIZING THE PURCHASE OF SERVICES TO REPAIR EXISTING SANITARY SEWER LINES WITHOUT FORMAL ADVERTISING AND COMPETITIVE BIDDING, AND DECLARING AN EMERGENCY WHEREAS, it is the desire and objective of the city of Dublin to identify and resolve the existing sanitary sewer infiltration/inflow problem as expeditiously as possible; and, WHEREAS, Council has already authorized the purchase of sewer video inspection equipment to achieve said objective; and, WHEREAS , it is anticipated that inspection of existing sewer lines may locate broken pipe sections, sags in the pipe causing leaks, or illegal cross connections requiring immediate repair to reduce inflow/ infiltration in the system; and, WHEREAS, Section 8.02(B) of the Dublin Charter enables Council, by ordinance or resolution adopted by a vote of at least two-thirds of its member s , to authorize, without advertising and competitive bidding, contracts or expenditures for any purpose where the statutory or common law of Ohio does not require competitive bidding; and, WHEREAS, Section 735.051 of the Ohio Revised Code enables the legislative authority of a city to authorize, by a two-thirds vote of its members elected thereto, the City Manager, or other duly authorized contracting authority, to enter into a purchasing contract without formal bidding and advertising, when a real and present emergency arises in connection with the operation of any department, division, commission, bureau, or board of the municipality; and, WHEREAS, Council believes that a real and present emergency exists within the City of Dublin; NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, I State of Ohio, 7 of the elected members concurring; I I Section 1. That, pursuant to Section 8.02 of the Dublin Charter and section 735.051 of the Ohio Revised Code, the purchase of services to repair existing sanitary sewer lines, without formal advertising and competitive bidding, in the amount of $100,000.00 is hereby authorized from the amount authorized in the Capital Improvements Tax Fund, account D10-07-7A-250C, for sewer rehabilitation. Section 2. That this Ordinance be, and hereby is, declared to be an emergency measure necessary for the preservation of the public health, i safety, and welfare and, therefore, this Ordinance shall take effect and be in force immediately upon its passage. Willis, city Engineer SUBJECT : Funds for Emergency Sewer Repair, 1&1 study DATE: April 5, 1990 The City has recently received video camera and video recorder equipment for use in inspecting sanitary sewer lines. The crew operating this equipment has finished its training and is now actively engaged in the inspection of critical sanitary sewer lines. It is anticipated that some significant sources of inflow and infiltration into the sewerage system will be found during the course of the inspections. This inflow and infiltration may be found to result from broken pipe sections, sags in the pipe which cause significant joint leaks, illegal cross connections to storm sewers and etc. These faults in the sewerage system will be collectively large enough to have a significant impact on the amount of flow reaching the main lift station during a heavy rain. We need to respond to and fix faults of this magnitude quickly. This will be best done by utilizing contractors who are throughly experienced in the installation of sewer piping. The contractors who are utilized must be available to us on short notice. Because amounts and types of work are not known at this time, they \-Jill work on and be paid on either a "cost plus" or a "time and materials" basis. Toward that end, an ordinance to set aside a block of funds and to authorize the Manager to spend money from that allocation for emergency sewer repairs will be presented to Council on April 16u, . This ordinance should also include the ability to hire equipment which will be needed to get the video equipment into areas which are otherwise inaccessible to that equipment. It is suggested that the entire $100,000 which is budgeted in the Capital Improvements budget for sewer line rehab be utilized for these emergency repairs. cc: Johnson file
