Un' . nnmnnm.nnmn19n AN ORDINANCE TO ACCEPT THE LOWEST/BEST BID FOR THE FRANTZ ROAD/DUBLIN ROAD GATEWAY PROJECT, AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE A CONTRACT FOR SAID PROJECT WHEREAS, after advertising, receiving bids and opening said bids on Tuesday, April 10, 1990 for the Frantz Road/Dublin Road Gateway Project; and WHEREAS, Council has determined that the lowest and best bid for said project is from Riepenhoff Landscape Inc. in the amount of $23,626.00; and NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, 7 of the elected members concurring: - Section 1. That the bid from Riepenhoff Landscape, Inc. in the amount of $23,626.00 be, and hereby is, accepted. Section 2. That the City Manager be, and hereby is, authorized and directed to execute a contract with Riepenhoff landscape, Inc. for above mentioned project. Section 3. That this Ordinance shall take effect and be in force from the earliest period allowed by law. MEMORANDUM To: Members of Council From: patrik Bowman, Planning Director Subject: Frantz Rd./Dublin Rd. Gateway Project Date: April 12, 1990 On April 10, 1990, bids were opened for the Frantz Rd./Dublin Rd. Gateway Landscaping Project. The low bid was $23,626.00 from Riepenhoff Landscape, Inc. This bid is approximately $3,000 less than the landscape planner's estimate. Riepenhoff Landscape, Inc. has extensive experience in both residential and commercial developments. The subcontractor, Lintner and Luft stone masons, also have extensive experience. Examples of their work include the stone walls at Llewellyn Farms Park and Chamber's Gateway. There were two issues regarding the low bid and they have been resolved. Specifically, the bid forms were submitted loose leaf and not in the book form. All the required forms were submitted and legal counsel does not feel this is a substantive error. Secondly, there were two different bid amounts. One amount was listed on the bid schedule and another amount was listed on the proposal form. The reason for the discrepancy is that the person preparing the bid included the cost of obtaining the bond on the proposal form and he did not include it on the bid schedule. Legal counsel feels that these two issues are not substantive and that the bid can be awarded to the lowest and best bidder, Riepenhoff Landscape for $23,626.00. Because the bid is valid for 60 days, I am respectfully requesting that Council, at minimum, adopt emergency legislation at anyone of the three reading dates. PB:jk 1 I I I I I I I I II . Bowman, Planning Director Subject: Frantz Rd./Dublin Road Gateway Ordinance No. 38-90 Date: May 2, 1990 Staff is requesting that this ordinance be passed as emergency legislation at the second reading scheduled for May 7, 1990. At this time of the year, it is getting more difficult to obtain plant material. Passing the ordinance as an emergency will help to keep the number of plant material substitutions to a minimum. Staff has investigated different methods for lighting the Dublin Road and Old Dublin Road intersection and is recommending that two street lights be installed. One is to be located directly at the intersection and the other is to be located approximately 120 feet southwest of the intersection along Dublin Road. This second fixture will help to accentuate the curve of the road and enable motorists better clear sight distance. Utilizing the KIM light fixture, the intersection will be lit while controlling off-site glare at the same time. The preliminary estimate for this lighting project is approximately $9,000. Harding, Director of Personnel & Purchasing Attached for your consideration please find Ordinance No. 37-90 amending Sections 7 and 15 of Ordinance No. 17-90 ("Compensation Plan"). Staff believes that these amendments are necessary to clarify a previous amendment to Section 7 of said Ordinance regarding vacation accrual and usage for new employees of the City and to also clean-up some other language within Section 7 impacted by said amendment which could be interpreted as contradictory or inconsistent with the intent of said amendment. (To assist in following the aforementioned amend- ments, I have enclosed the applicable pages of Ordinance No. 17-90 and have highlighted the effected areas in both Ordinance No. 17-90 and Ordinance No. 37-90.) The concern of Staff is specific to Sections 7A. (2nd paragraph), 7B, 7C, and 15, of Ordinance No. 17-90. Section 7A. (2nd paragraph) of Ordinance No. 17-90 has been re-drafted to clarify its intent and has been re-assigned to Sections 7C. and 7D. under the amendment to Section 7 contained in Ordinance 37-90. Section 7B. of Ordinance 17-90 has been re-drafted to eliminate any possible contraction or inconsistency in interpretation relative to the intent of new sections 7C. and 7D. under Ordinance No. 37-90 and remains as Section 7B. under the amendment to Section 7 contained in Ordinance No. 37-90. Section 7C. of Ordinance No. 17-90 has been re-drafted and now appears as Section 7E. under the amendment to Section 7 contained in Ordinance No. 37-90. (In addition, please note that sections 7D. through 7I. of Ordinance No. 17-90 now appear as Sections 7F. through 7K. under the amendment to Section 7 contained in Ordinance No. 37-90, however, they contain the same verbiage as that contained in Ordinance 17-90.) Section 15 of Ordinance No. 17-90 has been re-drafted to add Sections 7C, and 7D, in order to be consistent with the language in both of those Sections exempting them from retroactivity to January 1, 1990. Section 15 of Ordinance No. 17-90 remains Section 15 under the amend- ment to Section 15 contained in Ordinance No. 37-90. DLH/mc
