AN ORDINANCE AMENDING SECTIONS 7 AND 15 OF ORDINANCE NO. 17-90 ("COMPENSATION PLAN") WHEREAS , Council has determined, upon the recommendation of the City Manager and Director of Personnel & Purchasing, that it is advisable to amend the above captioned sections of Ordinance No. 17-90 ("Compensation Plan"); and, WHEREAS, Council believes that said amendments are necessary to clarify certain provisions contained within Sections 7 and 15 of said Ordinance; NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, 7 of the elected members concurring: SECTION l. That Section 7 (Vacation Leave) of Ordinance No. 17-90 be deleted and replaced with the following: SECTION 7. VACATION LEAVE A. All employees serving in Full-Time Permanent positions shall be entitled to vacation leave with pay based upon the following schedule: Complete Years of Vacation Days (Hours) Public Service Per Year o Year - 1 Year 5 days ( 40 hours) 2 Years - 4 Years 13 days (104 hours) 5 Years - 10 Years 15 days (120 hours) 11 Years - 15 Years 18 days (144 hours) 16 Years - 20 Years 20 days (160 hours) 21 Years or more 24 days (192 hours) B. An employee of the City, who has prior service with the State of Ohio or any po li tical subdivision of the State of Ohio, shall be entitled to receive credit for his/her prior service with these employees for the purpose of computing the amount of his/her vacation leave with the City. C. A new employee of the City, with less than one (1) year of prior public service as identified under Section 7 B. above, shall not, within the first six (6) months of his/her employment with the City, accrue or use vacation leave and, during the remaining six (6) months of his/her first year of employment, said employee shall accrue and be entitled to use up to a maximum of five (5) days (40 hours) of vacation leave. (This provision shall be implemented on the date this Ordinance takes effect and shall not be retroactive to January 1, 1990.) D. A new employee of the City, with more than one (1) year of prior public service as identified under Section 7 B. above, shall be entitled to accrue vacation leave immediately upon appointment, pursuant to the schedule identified in Section 7 A., provided that proper verification of said prior public service is received by the City, and said employee shall be entitled to use vacation leave after the mid-point (3 months) of the his/her six (6) month proba- tionary period. (This provision shall be implemented on the date this Ordinance takes effect and shall not be retroactive to January 1, 1990.) E. Procedures governing the use and approval of vacation leave are also contained with Section 8.03 of the Code of Personnel Practices & Procedures. F. An employee may carry over, from one calendar year to another, a maximum of ten (10) days (80 hours) of vacation leave previously accrued but not used, without obtaining approval from the City Manager. With the approval of the City Manager, an employee may carry over a maximum of twenty (20) days (160 hours) of vacation leave previously earned but not used. At no point in time shall an employees accrued vacation balance exceed twenty (20) days (160 hours). H. Employees are encouraged to utilize this benefit for the purpose for I which it is intended - e.g. rest, relaxation, travel, etc. There- fore, payment for accrued vacation leave in lieu of actual use shall not be approved, except when an employee terminates employment, dies, or is laid off. I. If an employee is ordered to work while on approved vacation leave, he/she shall be paid the double-time rate, with a minimum guarantee of four (4) hours pay for each such call in. J. Vacation leave may be taken in minimum multiples of one-quarter hour. K. The City shall determine the method of crediting vacation leave. SECTION 2. That Section 15 be deleted and replaced with the following: SECTION 15. The provisions contained within this Ordinance, with the exception of Sections 7 C., 7 D., and 13 E. shall become effective January 1, 1990. SECTION 3. That this Ordinance shall take effect and be in force on the earliest date permitted by law. Passed this 21st: day of May , 1990.
