There is a minor problem which I feel I can set out best in this letter rather than in discussion before council. You may recall that I alluded to it at the second reading. As you know, Coffm an Road will P.ass through this parcel on its way to Tuttle Road. The Dublin thoroughfare plan provides for an 80' ROW for tJlis road, but there has been discussion (see the Coffm an Road Study) of making the Coffm an Road extention a 112' ROW. Immediately to the south of this parcel, in the City of Colum bus , the road (Britton Parkway) is an 80' ROW. At P&Z, the staff report initially read that the dedication for Coffm an Road would be in accord with the thoroughfare plan and that the City would determine the amount and location of the dedication. However, prior to discussion, Pat Bowman orally modified the staff report to read that the dedication would be in accord with the thoroughfare plan and the amount and location would be negotiated with the applicant. Unfortunately, when the minutes were transcribed, Pat's modification of the staff report was omitted, and it appears in the minutes that the action of P&Z was in accord with the original version of the staff report, not the modified version we agreed to. The vote of P&Z, conditioned on the staff report, was correct; it is just that the explanation in the minutes of what the staff report contained was incorrect. I have listened to the tape of the meeting, and Pat's statements are very clear, so I do not feel that there will ultimately be any problem with P&Z amending the minutes the correct the oversight. I would simply request that in your action tonight, you act on the ordinance as recommended by the Planning and Zoning Commission, rather than specifying the conditions for approval. That way, once P&Z has amended their minutes to include the ommitted modific ation of the staff report, the record will be correct for both the City and the applicant. (J;ulY Yours, topher T. An excerpt of the minutes is as follows: "Mr. Kranstuber moved for approval of the rezoning application with the following conditions: 1. That the applicant agree to plat and dedicate the right-of-way for Coffman Road as shown in Dublin's Thoroughfare Plan. The amount and location of the right-of-way will be determined by the City. To make the determination, the City will conduct a preliminary engineering study that will show how best to tie the planned Dublin boulevard section to the proposed typical selection of the road in the City of Columbus. 2. That the applicant agree to construct the extension of Coffman Road (three lanes) as proposed in the Dublin Thoroughfare Plan. The issuance of a building permit for anyone development or successive developments totalling 250,000 square feet or greater will necessitate the construction of the road. In this event that building construction does not trigger the roadway construction, the property owner will be obligated to construct the road when the road is constructed north of Rings Road by others. 3. That the applicant dedicate right-of-way equal to 40 feet from centerline along the south side of Rings Road in compliance with the Dublin Thoroughfare Plan. The applicant shall cooperate with the city Engineer to determine if a roadway ditch is needed and to build the resultant ditch as per the approval of the city Engineer. 4. The applicant shall build the proposed ditch along the north and east property line as per the direction of the city Engineer. Plans for this work must be approved by the city Engineer. (Approved 7-0) In July of 1990, city Engineer Paul willis determined that the pavement width for Enterprise Court was appropriate and acceptable to his department at 32 feet. 5. Rezoning Application Z90-004 - Rings Road Mr. Bowman presented slides of the site and surrounding area along wi th information regarding the rezoning proposal as outlined in the Staff Report dated April 5, 1990. The site contains 34.818 acres (Smith tract) located at the southwest corner of 1-270 and Rings Road. It is currently zoned R-1A, Restricted Suburban Residential District and is located within Washington Township. The site is part of a large annexation which is still pending, and this application is contingent upon that approval by Dublin city Council. The applicant is proposing to rezone the site to SO, Suburban Office and Institutional District. This is consistent with the area plan which promotes office and mUlti-family uses along the main thoroughfares. with the extension of Coffman Road to the Tuttle Road Interchange reasonably assured, it is very likely that the property will attract higher density offices or large, single corporate users. Staff recommended approval of the rezoning request with several conditions listed in the Staff Report, with Condition #2 revised to "developments totalling 250,000 (not 150,000) square feet..." Mr. Chris Cline, attorney representing the F. A. Kohler Company, the applicant, generally agreed with the conditions listed in the Staff Report. However, he expressed concern about #3 regarding the dedication of right-of-way equal to 40 feet from centerline along the south side of Rings Road in compliance with the Dublin Thoroughfare Plan, stating that the applicant had agreed to provide the 40 feet at the point of the intersection with Coffman Road, but it may be difficult to widen the road any further because of the bridge. Mr. Bowman stated that if the Thoroughfare Plan is amended with Rings Road no longer being represented as a major road, the City will consider reducing the right-of-way dedication. with this provision, Mr. Cline stated his agreement with Condition #3. Minutes of Meeting, April 5, 1990 Dublin Planning and Zoning commission Page 10 Mr. steve Martin, 5685 Rings Road, demonstrated the location of his home with the proposed relocation of Rings Road abutting his side yard. He suggested moving the road southward, leaving the residential area as it exists today. Mr. Cline stated that the future location of the road is in no way affected by this rezoning. He stated that the relocation of Rings Road was done for the sole purpose of protecting and emphasizing single-family homes in this area and will continue to be the focus of future rezoning applications in this area. Mr. Bowman stated that the plan represents the concept, not the specific uses. What the new road represents (the one that goes diagonally and cuts Rings Road off) is way to carry the thru- traffic. Mr. Martin reiterated his request to have that road relocated southward through the commercial area. Mr. Cline again noted that this rezoning in no way determines the location of that road. The location of that road will basically be dependent upon the agreement of the various area land owners (i.e., Mr. Barney, residents along Rings Road, and Mr. Swanson). Mr. Bowman stated that the installation of the road may well be a municipal obligation, and the roadway configuration will continue to be examined with the intent to keep traffic off the western portion of Rings Road. Mrs. Melvin asked about the applicant's intention for development of the site. Mr. Cline responded that the applicant will most likely attempt to develop the site to the highest and best use possible, similar to what will be done across the freeway. He stated that high-scale "Metro Center-type" uses are likely next to the freeway with smaller-scale offices further west. Mrs. Melvin noted concern about restaurant use in this area. Mr. Tom Dalcolma, representing the applicant, stated that it is unlikely that there will be a stand-alone restaurant in that area. The intention is for this site to be developed with corporate, quality office space, out-parcel type development will be concentrated around the Tuttle Road interchange. Mr. Kranstuber expressed that as many citizens as possible in the area need to be contacted about proposed rezonings. Mr. Bowman agreed to meet with any interested citizens before this rezoning proposal is heard by City Council. Mr. Kranstuber moved for approval of the rezoning application with the following conditions: 1. That the applicant agree to plat and dedicate the right-Of-way for Coffman Road as shown in Dublin's Thoroughfare Plan. The amount and location of the right-of-way will be determined by the City. To make the determination, the city will conduct a preliminary engineering study that will show how best to tie the planned Dublin boulevard section to the proposed typical selection of the road in the City of Columbus. 2. That the applicant agree to construct the extension of Coffman Road (three lanes) as proposed in the Dublin Thoroughfare Plan. In the event that building construction does not trigger the roadway construction, the property owner will be obligated to construct the road when the road is constructed north of Rings Road by others. 3 . That the applicant dedicate right-of-way equal to 40 feet from centerline along the south side of Rings Road in compliance with the Dublin Thoroughfare Plan. Concept Plan - Proposed Phase 44 Muirfield village Mr. Bowman presented slides of the site and surrounding area along with information contained in the Staff Report dated April 5, 1990. The. subject site, currently zoned R-1, is located to the north and east of the corner of Avery and Brand Roads. The site contains two separate parcels with a combined acreage of 44.3 acres and surrounds the former Gasbarrow/Pi home on three sides. The applicant maintains that the 37.9 acre tract is subject to the provisions of the original General Warranty Deed of Muirfield village. The applicant proposes to develop the site with 75 single-family lots, and if the concept is favorably received, will proceed with rezoning to the PUD, Planned Unit Development District. Staff favors the Concept Plan because single-family land use at the density proposed is very consistent with the area. Several issues requiring resolution prior to rezoning were outlined in the Staff Report for discussion purposes. Mr. Mack expressed the importance of compliance with the flood protection regulations and noted that he is not sure the br idge shown on the plan would be permitted. Steve Lenker, the applicant of Muirloch Development Company, stated presented a plan board of the proposal. He stated that the 37 acre parcel was made subject to the provisions of the General Warranty Deed of Muirfield village in March, 1989. He added that the Muirfield Association Board of Trustees had determined in a meeting earlier that week that the 6.5 acre parcel would not be subject to those provisions at this point in time. Mr. Lenker addressed the issues raised in the Staff Report as follows: -Loop circulation pattern vs. single curb cut - needs additional review prior to determination being made. -Treatment along Brand Road - should be mounded and landscaped with a minimum of 50 percent opacity. Minimum setback of 100 feet is shown on plan and would be in addition to 20 percent of lot depth. -100-year floodway shown on plan was taken from latest maps available with no delineation between floodway and floodway fringe areas shown.
