Form No. 30043 . 32-90 Passed____ u mnnmmnm_m mm19u OrdInance NO.n mmum_____U AN ORDINANCE AUTHORIZING THE PURCHASE OF ADDITIONAL SAFETY EQUIPMENT, WITHOUT FORMAL ADVERTISING AND COMPETITIVE BIDDING, FOR THE SEWER IN- SPECTION PROGRAM, AMENDING THE ANNUAL APPROPRIATIONS, AND DECLARING AN EMERGENCY WHEREAS, it is the desire and objective of the City of Dublin to resolve the existing sanitary sewer infiltration/inflow problem in an expeditious yet safe manner; and WHEREAS, Section 8.02(B) of the Dublin Charter enables Council, by ordinance or resolution adopted by a vote of at least two-thirds of its members, to authorize, without advertising and competitive bidding, contracts or expenditures for any purpose where the statutory or common law of Ohio does not require competitive bidding; and WHEREAS, Section 735.051 of the Ohio Revised Code enables the legislative authority of a city to authorize, by a two-thirds vote of its members elected thereto, the City Manager, or other duly authorized contracting authority, to enter into a purchasing contract without formal bidding and advertising, when a real and present emergency arises in connection with the operation of any department, division, commission, bureau, or board of the municipality; and WHEREAS, Council believes that a real and present emergency exists within the City of Dublin; NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, ~of the elected members concurring: Section 1. That, pursuant to Section 8.02 of the Dublin Charter and Section 735.051 of the Ohio Revised Code, the purchase of certain additional safety equipment, without formal advertising and competitive bidding, in the amount of $18,640.00, is hereby authorized. Section 2. That there be appropriated from the unappropriated balance in the CAPITAL IMPROVEMENT TAX FUND, the sum of $18,640.00 to account D10-07-7A-250I. Section 3. That this Ordinance be, and hereby is, declared to be an emergency measure necessary for the preservation of the public health, safety, and welfare and, therefore, this Ordinance shall take effect and be in force immediately upon its passage. Hansley, City Manager SUBJECT: Emergency Purchase of Additional Safety Equipment for the Sewer Inspection Program DATE: March 19, 1990 BY: David L. Harding, Director of Personnel and Purchasing Attached for your consideration please find Ordinance No. 32-90 authorizing the purchase of certain additional safety equipment, without formal advertising and competitive bidding, for the sewer inspection prorgram, amending the annual appropriations, and declaring an emergency. Also attached please find a memorandum from Danny L. Johnson, Superintendent of Maintenance, detailing the costs associated with purchase of said equipment. Since it is the desire and objective of the City of Dublin to resolve the existing sanitary sewer infiltration/inflow problem in an expeditious yet safe manner and, since, to achieve this objective, it is absolutely critical to purchase certain additional safety equipment immediately, Staff recommends that pursuant to Section 8.02 of the Charter and Section 735.051 of the Ohio Revised Code, formal advertising and competitive bidding be waived and said equipment be purchase on an emergency basis. Johnson, Maintenance Superintendent Re: Safety equipment costs for sewer inspection crew Date: March 19, 1990 In my original estimate for costs for initiating a sewer inspection program I estimated $7,000 - $8,000 for safety equipment for the employees, which I would have purchased out of my operating budget. This figure was too low. I failed to consider OSHA rule #1910.46 which requires gas meters in each manhole. I also failed to consider that I would need 2 employees in the manholes (one at each end of the section being tested). Therefore, I need an additional $18,640 to be allocated for the program. DLJ/tb
