O. ~ Form No, 2S06-A Ordinance No,_~__.J)4~:8]_n~(As Amended) Passed~_____~m~~um____ nun __m__m19_~n_ __ AN ORDINANCE TO AMEND SECTION 1105.07 OF THE CODIFIED ORDINANCES OF THE VILLAGE OF DUBLIN, OHIO WHEREAS, depending on the nature of the improvements to be finanlized before a building permit can be issued, the language in Section 1105.07 of the Codified Ordinances of the Village of Dublin may be considered too severe and; WHEREAS, it is the desire of the Village Council to be able to grant some discretionary relief from said Section 1105.07, an amendment is now being proposed: NOW, THEREFORE, BE IT ORDAINED by the Council of the Village of Dublin, State of Ohio, 4 of the elected members concurring: Section 1. That Section 1105.07 of the Codified Ordinances of the Village of Dublin which now reads: "Construction of buildings shall not be permit- ted until all improvements leading to that lot are completed and accepted by the Municipality, be amended by adding the folloinwg, "exceptions to this Section may be granted solely at the discretion of the Villa2e Mana2el. Section 2. That the ordinance be amended to include the recommendation that the request include review by the Village Engineer and the Chairman of the Public Service Committee (See Exhibit A.) Section 3. That this Ordinance shall take effect and be in force from and after the earliest period allowed by law. The vote on the underlying ordinance was as follows: Mr. Amorose, no; Mr. Jankowski, no; Mayor Close, no; Mr. Sutphen, yes; Mr. Rozanski, yes; Ms. Maurer, yes; Mr. Thornton, yes. .~ TO: Councilmembers and Law Director FROM: Sherman Sheldon - Village ~~nager RE: Amendment ~o Section 1105.07 - Ord. 04-87 DATE: December 30, 1986 With the many request associated with builders and developers desiring building permits prior to all improvements being completed and accepted by the Village, the attached Ordinance has been submitted for your consideration. In some instances, primarily in the late Fall and Winter, there are items such as broken curbing, seeding, asphalt patching etc., that cannot be repaired until warmer weather returns. Depending on the extent and nature of the work required to complete the improvements, the Village Council may wish to have the ability to grant some relief to said builders and developers by permitting exceptions soley at the discretion of the Village Manager. The attached Ordinance for your consideration provides this ability to Council.
