Form No, 30043 .--.,----------- --.---- ----------~- II co~~~~~ c, \1" Ordinance No,u "lU6c9,Qm Passed ------ .-- - 19_ . _._~-_._.'-- -------- -----.-------.--- ----------- II Ii AN ORDINANCE AUTHORIZING 11 I) THE PURCHASE OF SEWAGE FLOW METERS FOR THE DUBLIN SANITARY Ii SEWAGE COLLECTION SYSTEM II " 'I Ii Ii WHEREAS, it is the desire and objective of the city of Dublin to continue iI_",' to identify and resolve the existing sanitary sewer infiltration/inflow ,[ problem as expeditiously as possible; and, II I, 11 WHEREAS, it is the desire of Council to closely monitor the flow " i: characteristics of collection system into the future through an 'I our I: ongoing and continuous flow monitoring program; and, i! , , I WHEREAS, the City's consulting engineer, Burgess & Niple, Limited, and the , city Engineer have reviewed the available types of flow meters which are 11 currently utilized for the purpose of monitoring sanitary sewer flows; Ii and, " i WHEREAS, the Ohio Environmental Protection Agency has issued Findings and Orders for the city of Dublin which require the City to maintain an on- going inflow and infiltration program and to measure the effects of the improvements made to the sanitary sewage collection system; and, WHEREAS, Section 8.02(B) of the Dublin Charter enables Council, by ordinance or resolution adopted by a vote of at least two-thirds of its members, to authorize, without advertising and competitive bidding, contracts or expenditures for any purpose where the statutory or common law of Ohio does not require competitive bidding; and, WHEREAS, Section 735.051 of the Ohio Revised Code enables the legislative authority of a city to authorize, by two-thirds vote of its members elected thereto, the City Manager, or other duly authorized contracting ,." authority, to enter into a purchasing contract without formal bidding and advertising, when a real and present emergency arises in connection with the operation of any department, division, commission, bureau, or board of the municipality; and, WHEREAS, Council believes that a real and present emergency exists within the City of Dublin; NOW, THEREFORE, BE IT ORDAINED by the Council of the city of Dublin, State of Ohio, 7 of the elected members concurring; section 1- That, pursuant to section 8.02 of the Dublin Charter and section 735.051 of the Ohio Revised Code, the purchase of flow monitoring devices to monitor sewage flows within the City's collection system without formal advertising and competitive bidding in the amount of $125,000.00 is hereby authorized in the capital Improvements Tax Fund, account D10-07-7A-250C, for sewer rehabilitation. section 2. That this Ordinance be, and hereby is, declared to be an emergency measure necessary for the preservation of the public health, safety, and welfare and, therefore, this Ordinance shall take effect and be in force immediately upon its passage. day o~ovember , 1990.
