AN ORDINANCE TO AUTHORIZE THE
ESTABLISHMENT OF THE ENFORCE-
MENT AND EDUCATION FUND AS
REQUIRED BY THE AUDITOR OF
STATE
WHEREAS, Section 4511.99, Revised Code, establishes penalties for viola-
tions involving Section 4511.19, Revised Code, driving while under the
influence of alcohol or drugs; and,
WHEREAS, House Bill 837 made statutory changes to Section 4511.99, Revised
Code, that affect the accounting treatment of OMVI related fine money; and,
WHEREAS, Section 4511.99, Revised Code, now establishes an additional
distribution of fine money to the law enforcement agency responsible for
the arrest of the offender; and,
WHEREAS, the fine money is to be deposited in a special fund.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State
of Ohio, 7 of the elected members concurring that:
Section 1. There be established the Enforcement and Education Fund, a
Special Revenue Fund.
Section 2. The fines received by the City's Division of Police in
accordance with Section 4511.99, Revised Code, be deposited with the
Department of Finance to the credit of the Enforcement and Education Fund.
Section 3. This fund be used by the Cityls Division of Police to pay
only those costs it incurs in enforcing Section 4511.19, Revised Code,
and in educating the public of laws governing operation of a motor
vehicle while under the influence of alcohol, the dangers of operation
of a motor vehicle while under the influence of alcohol, and other
information relating to the operation of a motor vehicle and the
consumption of alcoholic beverages.
Section 4. This Ordinance shall take effect and be in force from the
earliest period allowed by law.
