094-90 Ordinance RECORD OF ORDINANCES Dayton Legal Blank Co, Form No, 30043 Ordinance No. 94-90 Passed un19n . ----~-------- - - -- - - --- - ~. - AN ORDINANCE TO AUTHORIZE THE POLICE CHIEF TO ACCEPT SEIZED AND FORFEITED CASH, VEHICLES AND PROPERTY RELINQUISHED IN ACCORDANCE WITH SECTION 2933.43 OF THE OHIO REVISED CODE, AND TO AUTHORIZE THE ESTABLISHMENT OF THE LAW ENFORCEMENT TRUST FUND. WHEREAS, Section 2933.43, Revised Code, provides for state and local law enforcement agencies that actively and directly participate in contraband property seizures and forfeitures of property to receive all or part of the property forfeited; and, WHEREAS, prior to the acceptance of cash, vehicles, or property, the legislative authority of the City must authorize that the head of the law enforcement agency having custody of the forfeited property has the discretion of selling the property, destroying the property or retaining the property for law enforcement use; and, WHEREAS, all cash or cash proceeds must be deposited into a law enforce- ment trust fund. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, ~of the elected members concurring that: Section 1. The Police Chief be and is hereby authorized and directed to accept cash, vehicles, and other property in accordance with Section 2933.43, Revised Code. Section 2. There be established the Law Enforcement Trust Fund, a Special Revenue fund, in which the Police Chief shall deposit all cash received. Section 3. The fund be used only to pay the costs of prolonged or complex investigations or prosecutions, to provide reasonable technical training or expertise, to provide matching funds to obtain federal grants to aid law enforcement, or for such other law enforcement purposes that the Council determines to be appropriate. Section 4. The Police Chief has the authority to determine whether vehicles and property will be sold, destroyed or retained for use by the Division of Police. Section 5. All vehicles and property retained by the Division of Police be included as part of the Division's fixed assets and used solely for law enforcement purposes. Section 6. Cash proceeds from the sale of vehicles and property shall be deposited in the Law Enforcement Trust Fund. Section 7. This Ordinance shall take effect and be in force from the - -
