Form No. 2806-A Ordinance No. 64-87 Passed ------------ ----- __n19__ AN ORDINANCE AUTHORIZING THE ACTING VILLAGE MANAGER TO ENTER INTO A CONTRACT WITH THE FRANKLIN COUNTY BOARD OF COMMISSIONERS TO PROVIDE PRISONER BOARDING SERVICES AND ESTABLISHING A PER DIEM RATE, AND DECLARING AN EMERGENCY WHEREAS, the Village of Dublin does not have the proper facilities to provide for detention and imprisonment; and WHEREAS, the Franklin County Correction Center has previously been utilized to provide said services; and WHEREAS, a proposal has been received from the Franklin County Commissioner to continue to house our prisoners at a new per diem rate; NOW THEREFORE, BE IT ORDAINED, by the Council of the Village of Dublin, State of Ohio, 6 of the elected members concurring: Section 1. That the Acting Village Manager and Finance Director be, and hereby is, authorized to enter into a contract with the Franklin County Commissioners to house prisoners at a rate of $32.42 per diem. Section 2. That this Ordinance be, and the same hereby is, declared to be an emergency measure necessary to preserve the public health, safety and welfare and therefore shall take effect and be in force immediately upon its passage. Such use is available at the actual cost of running the facility, with no premium charged for the liability exposure of Franklin County. We have recently completed a reconciliation of Jail costs, and have calculated a new per diem figure for utilization of that facility. The attached contract reflects that new "actual cost" figure, which will be updated annually. In order to give you adequate notice the effective date of the new hous ing of prisoners rate is July 1, 1987. By execution of the attached contract the Board of County Commissioners agrees to house your prisoners in the Franklin County Correctional Facilities and to provide you with a monthly itemized invoice for these costs. If you wish to continue your participation in the program, please execute the attached contract and return it to the Board of County Commissioners prior to June 15, 1987. Thank you. WITNESSETH: Municipality is not provided with a workhouse or other jail for imprisonment of those who violate ordinances of said municipality and therefore pursuant to the provisions of Section 1905.35, Ohio Revised Code, hereby contracts for the use of the Franklin County Correction Center for such purposes and at the expense of the said municipality. l. In consideration of the promises and agreements of the Municipality, herein set forth, Board promises and agrees as follows: a. The Sheriff of Franklin County will receive, safely keep, board, and maintain in the Franklin County Corrections Center those prisoners who have been imprisoned under the ordinances of the Municipality. b. Said Sheriff shall receive and hold such persons in the manner prescribed by the ordinances of Municipality. 2. In consideration whereof, the Municipality hereby promises and agrees as follows: a. To pay the Board a perdiem rate for each municipal prisoner incarcerated of $32.42. 3 . It is mutually agreed by and between the parties hereto upon the said consideration as follows: a. Persons so imprisoned are under the charge of the Sheriff of Franklin County, and subject to the rules, regulations and discipline of said Franklin County Correction!'; Center, the same as other prisoners therein detained. b. All expenses of transporting prisoners, including their return to the place from which they were sentenced and including the expense of retaking prisoners who may violate any probation/parole when such probation/parole is granted with the consent of the sentencing tribunal shall be paid in all cases by Municipality. c. No person under eighteen years of age shall be received. d. All reasonable and necessary expense incurred by Board in any habeas corpus proceedings for or against any such prisoner shall be paid by Municipality unless otherwise paid. e. .HI Llle eVeLlL Lne llllleSS Ol lllJUlY 01 allY S U C; II jH: -~ {;(Jfi~ C , requiring hospitalization or special treatment or other expense, or in the event of any other occurrence causing extra expense to the Board in connection wi th any such prisoners not herein provided, all such extra expense shall be paid by Municipality. f. The Board will bill the Municipality monthly for perdiem charges of the prior month and the Municipality will pay the bill with in 30 days after receipt. g. Either part to this contract may terminate the same, except as to prisoners already received, by giving si.xty (60) days notice in writing to the other party. h. This contract shall commence on the 1st day of July, and shall be in full force and effect until otherwise terminated prior thereto as provided herein. All former contracts are hereby cancelled.
