093-86 Ordinance RECORD OF ORDINANCES 263 Natkmal Graphics Corp., Cols., O. ~ Form No. 2806-A Ordinance NO,__m~_3.::_~_~nuuuu P assed_nn n__nn_ _n_nn_ nn_____nu__unnnu___19 __ n_ __ AN ORDINANCE TO CONTRIBUTE FUNDING FOR THE RECONSTRUCTION OF THE ROADWAY AND DRAINAGE DITCHES OF A PORTION OF WOERNER-TEMPLE ROAD AS ORIGINALLY APPROVED BY THE DUBLIN VILLAGE COUNCIL ON JULY 20, 1981, SAID CONTRIBUTION TO BE MADE IF AND WHEN THE IMPROVEMENTS ARE MADE;. WHEREAS, Washington Township accepted a bid on June 3, 1986 for the reconstruction of said Woerner-Temple Road in the amount of $503,959.70, and; WHEREAS, the Washington Township Clerk has now requested the Village to honor its committment made in 1981 in the amount of $l5,000.00; NOW, THEREFORE. BE IT ORDAINED by the Council of the Village of Dublin, State of Ohio, 7 of the elected members concurring; Section 1. That the Finance Director be, and hereby is, authorized and directed to make a payment to the Washinton Township Trustees in the amount of $l5,000.00 for the Village of Dublin share of the reconstruction of Woener-Temple Road. Section 2. That there be appropriated from the unappropriated funds in the General Fund to account AOl-06-6A-2550 the sum of $l5,000.00 to meet this obligation, Section 3. " CoUflCi~ --- TO: Councilmembers FROM: Sherman Sheldon - Manager RE: Woerner Temple Road DATE: November 12, 1986 As the attached letter and copies of Minutes will indicate, this matter dates back to 1981 when the Franklin County Engineer was requesting Washington Township to make improvements to Woerner Temple Road. Although I had forgotten after five (5) years, I had taken the matter before Council on July 20, 1981 prior to the Washington Township meeting of August 3, 1981 to see if Village Council was receptive to contributing to the project and, as noted in the Minutes of July 20, 1981, Council was unanimous in its support. Washington Township is now requesting that we honor this committment made in 1981 and, although I believe we should, I would rather give this Council an opportunity to discuss the matter and determine if they concur. If Council does concur, I would prepare an Ordinance for a future meeting to approve the expenditure and appropriate the necessary funds. Following many meetings and much discussion bids were requested for this construction in May of 1986 and the bid of $503,959.70 from Strawser Paving was accepted by the Board on June 3rd, 1986. Construction began immediately and is now near completion. Mr. Geese moved seconded by Mr. Shawan, to accept said plat as submitted and vote on the motion was unanimous. Discussion - County Engineer's Proposal - Woerner-Temple Road Mr. Sheldon commented on the request of the Washington Township Trustees, through the franklin County Engineer's office, to make road and ditch improve- ments on said road. To accomplish this, he said additional right of way is needed and some of the roadway and drainage ditch would be in the Dublin Corp or ate limits. The franklin County Engineer is requesting the Village to contri- bute an amount not to exceed $15,000.00. Mr. Sheldon said this would be a 1982 expenditure. He reconmended approval of said request because this srea is in the Village's sewer and water contract districts and if annexed to the Village in the future, it would be a good, low cost investment. Mr. Shawan moved, seconded by Mr. Chambers, to agree to contribute to the funding if and when improvements are made. Vote on the motion was unanimous for approval. Council Roundtable Discussion Mr. Mand said now that the Income Tax issue will be placed on the ballot in November, he would like to make a motion that Mr. Chambers be appointed by vote of the Council to organize and coordinate a campaign to explain the Income Taxi Capital Improvement Program to the public. Mr. Geese seconded the motion and the vote was as follows: 5 Yeas - Chambers, Geese, Mand, Maurer, Shawan; 1 Nay - Headlee. - Mr. Hand expressed concern with the procedure of the Board of Zoning Appeals. In particular, he said approval was given for construction of Sisters Chicken Restaurant by BZA after the Planning and Zoning Commission spent approximately a year discussing this issue. He said he has not heard what took place at the BZA meeting,such as whether both sides were legally represented, and feels more notification should be made of BZA's meeting dates and agenda. Mr. Sheldo said Jeffrey Rich, Chairman of BZA, is very prompt and consistent in publishing meeting dates and agendas of BZA in the Dublin forum prior to the Saturday morning meetings. Mr. Hand felt notification should be placed in a newspaper with a larger circulation Such as Suburban News. Mr. Chambers commented on his willingness to accept the responsibility of in- forming the voters about the Income Tax issues appearing on the November J ballot. He said he has consistently opposed an increase in the past but feels a good package is being offered and he is now in favor of an increase. He said there are some things he doesn't agree with in the package but it is the best that has been devised in three years. He said a good question to ask when considering approval of the ten or eleven items is "Should Dublin be wi thout these items fi ve years from November." Mr. Shawan thanked Mr. Sheldon for his prompt action in solving a sewer problem on River Knolls in which the County Board of Health had taken no action. ( Also, he said he was concerned about the appearance of the Bash Recreation - - Restaurant, Homesteader Inn. He said the air conditioning unit is on the west side of the building in full view of the public, the dumpster is not hidden, and landscaping is inadequate. He questioned how this passed through P&Z and what can be done now to get it in better condition. . Mr. Wolfe said he did not think the restaurant violated the Zoning Code. Mr. Smith said he would check to see if the restaurant was in comPliance with the Cod e. Mayor Headlee announced there is information available at the Municipal Buildin for energy credit for Senior Citizens.
