Form No, 2806-A Ordinance NO._____~_?.::~~_m___u Passed___nn unnn_n__nn__un___nu_n___nnn_19___n__ AN ORDINANCE APPROPRIATING FEE SIMPLE TITLE TO PROPERTY LOCATED AT CORBIN'S MILL DRIVE AND STATE ROUTE 161 AND DE- CLARING AN EMERGENCY. WHEREAS, the Village of Dublin is undertaking road improvements at Corbin's Mill Drive and Shawan Falls Drive; and, WHEREAS, said right-of-way located at the southwest corner of the Corbin's Mill/State Route 161 intersection is necessary for the alignment of Corbin's Mill Drive with Shawan Falls; and, WHEREAS, said right-of-way is also necessary to enable the Village to properly signalize said intersection; and, WHEREAS, prompt acquisition of this right-of-way and completion of said improvements is vital to the health, safety and welfare of the residents of the Village of Dublin. NOW, THEREFORE, BE IT ORDAINED by the Council of the Village of Dublin, State of Ohio, 7 members concurring that: Section 1. Fee simple title in and to the following described parcels of real estate be, and the same is, hereby appropriated for the public pur- pose of aligning and signalizing said intersection, pursuant to and in accordance with, Chapter 163 of the Ohio Revised Code and the Constitution of the State of Ohio, to wit: the two parcels of land described in Exhibits 1-4 attached hereto and incorporated herein. Section 2. The Council for the Village of Dublin hereby fixes the value of said fee simple interest at four thousand dollars ($4,000.00). Sec tion 3. The sum of four thousand dollars ($4,000.00) being the amount set forth in Section 2 herein be deposited with the Court of Common Pleas, Franklin County, Ohio, for the use and benefit of the owner of the property appropriated and upon such deposit with said Court, the Village of Dublin shall take possession of and enter upon such property pursuant to and in accordance with Chapter 163 of the Ohio Revised Code and the Constitution of the State of Ohio. Section 4. The Council of the Village of Dublin, Ohio, finds that the appropriation of property made herein is necessary for said public pur- poses; that the Village of Dublin has been unable to agree with the owner of the property appropriated herein, and that the Village of Dublin intends to obtain immediate possession of the above described property, which immediate possession is necessary for said public purposes. Section 5. The Village Law Director be, and is hereby, authorized and directed to file a petition for appropriation in a court of competent jurisdiction to have a jury impaneled to make inquiry into and assess the compensation to be paid for the real estate described above. Section 6. The sum of four thousand dollars ($4,000.00), or so much as may be needed, be, and the same hereby is, appropriated from Account A01-06- 6A-2550 for street capital improvements in the general fund. Section 7. This Ordinance is declared to be an emergency necessary for the immediate preservation of the public health, safety and welfare for the reason that said appropriation is necessary to enable the Village to properly signalize and align said intersection and that this Ordinance shall take effect and be in force immediately upon passage. . 17th November 1986.
