Passed _nn m _mnm _nn_ _19 n AN ORDINANCE ACCEPTING THE LOWEST/ BEST BID FOR RESIDENTIAL REFUSE AND GARBAGE COLLECTION SERVICES FOR THE CITY OF DUBLIN, OHIO, AUTHORIZING AND DIRECTING THE CITY MANAGER AND FINANCE DIRECTOR TO EXECUTE A CONTRACT FOR THE PROCUREMENT OF SAID SERVICES, AND DECLARING AN EMERGENCY WHEREAS, after advertising and receiving bids for Residential Refuse and Garbage Collection services for the City of Dublin, Ohio; and, WHEREAS, Council has determined that the lowest and best bid is from Johnson Disposal, Inc. in the amount of $4.89 per subscriber per month. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, 7 of the elected members concurring: Section 1. That the bid from Johnson Disposal, Inc. in the amount of $4.89 per subscriber per month be, and hereby is, accepted. Section 2. That the City Manager and Finance Director be, and hereby are, authorized and directed to execute a contract with Johnson Disposal, Inc. for the procurement of residential refuse and garbage collection services pursuant to the specifications and contract documents on file in the Office of the City Manager. The term of said contract shall be for three years (January 1, 1988 through December 31, 1990) with an option to extend through the fourth and fifth years upon mutual agreement of both parties. Section 3. That this Ordinance be, and the same hereby is, declared to be an emergency measure necessary for the preservation of the public he.alth, safety and welfare and for further reason that the present 90 day extension of the contract with Laidlaw Waste Systems expires on December 31, 1987, wherefore, this Ordinance shall take effect and be in force immediately upon its passage. Harding, Administrative Assistant ~ SUBJECT: Bids for Residential Refuse and Garbage Collection Services DATE: December 16, 1987 After advertising and receiving bid proposals for Residential Refuse and Garbage Collection services, said proposals were opened at 10:00 A.M. on Friday, December 11, 1987. Attached is a copy of the bid tabulation and Ordinance No. 148-87 accepting the lowest and best bid. After evaluating all bids, it was determined that Johnson Disposal, Inc. submitted the lowest and best bid (refer to attached bid tabulation). As noted on the attached bid tabulation, the two other bidders added to the content of the specifications by in- cluding a notation with their bids that acceptance of their bids by the City would be based on the understanding that the City would allow them to increase their prices if they were to experience an increase in their disposal costs. It should be noted that the specifications contained no such provision. As we discussed, I would agree with you that we should recommend acceptance of Bid No. 2 from Johnson Disposal, Inc. in the amount of $4.89 per subscriber per month with the knowledge that the City reserves the right, under the provisions of the project speci- fications, to modify the appropriate provisions of the contract in such a way as to select the other available options in the future, if the City decides to do so. In addition, Johnson Disposal has indicated their willingness to offer "garage-side" service for certain areas of the City, at some future point in time, depending on which areas of the City may desire such service and upon notification by the City. Pursuant to the bid specifications, Johnson Disposal has submitted a proposal bond in the amount of $10,000.00 to ensure that they wi 11 enter into a contract with the City within 10 days after notification of bid acceptance. Also, pursuant to the specifi- cations, Johnson Disposal will have 10 days from notification of bid acceptance to furnish the required contract (performance) bond in the amount of $250,000.00 to ensure their performance under the terms of the contract and project bid specifications. Also, please be advised that a potential legal dispute exists between Laidlaw Waste Systems and Johnson Disposal. Laidlaw has charged Johnson Disposal with breaching a "non-compete" agreement that allegedly exists between Laidlaw and two of the owners of Mid-America Waste Systems, the alleged parent company of which Johnson Disposal is a subsidiary. Laidlaw maintains that this agreement stipulates that the same two owners as mentioned above will not compete with Laidlaw within the geographic area in which Dublin falls. Laidlaw has indicated that they wi 11 file suit against Johnson Disposal and seek an injunction to prevent Johnson Disposal from executing a contract with the City of Dublin. Johnson Disposal maintains that said agreement is with an unrelated company known as Buckeye Waste Control and therefore, said agreement has no relevance to Johnson Disposal. Since the present 90 day extension of the contract with Laidlaw expires December 31, 1987, and since uninterrupted refuse and garbage collection services for the citizens of Dublin is necessary for the preservation of the public health, safety and welfare, I would respectfully recommend that Ordinance No. 148-87 be adoped as emergency legislation.
