AN ORDINANCE ESTABLISHING FEES
FOR ADJUDICATION PROCEEDINGS
INVOLVING THE BUILDING INSPECTORS,
CHIEF BUILDING OFFICIAL OF THE
CITY OF DUBLIN
WHEREAS, the Ohio Basic Building Code (OBBC) states under the adminis-
tration and enforcement Section 4101:2-1-35 that builders/contractors
have a right to appeal a decision made by either the Building
Inspector or the Chief Building Official (CBO) of Dublin in the course
of construction. That appeal is referred to the State Board of
Building Appeals for a hearing, which in turn renders a decision on
the appeal.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin,
State of Ohio 7 of the elected members concurring that:
Section 1. There is no fee for an appeal from the determination of the
Building Inspector when it is a question of Code interpretation.
Section 2. Wh e n it is not a question of Code interpretation and a
variance is requested, the fee is $500.00. The fee is to cover cost(s)
incurred by the Building Inspector and the Chief Building Official
in terms of time, travel, expenses.
Section 3. This Ordinance shall take effect and be in force from and
after the earliest period allowed by law.
