AN ORDINANCE ESTABLISHING A
BUILDING CONSTRUCTION APPEALS
BOARD IN THE CITY OF DUBLIN,
OHIO
WHEREAS, Section R-107 of the "CABO One and Two Family Dwelling Code"
states that "all persons shall have the right to appeal the building
official's decision through a body appointed by the appropriate authority
of the jurisdiction and qualified by experience and training to pass
upon matters pertaining to building construction".
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin,
State of Ohio, 7 of the elected members concurring that:
Section 1. It is necessary to form a Building Construction Appeals Board
for the Dublin Building Department to hear all appeals not related to
the "Ohio Basic Building Code" (OBBC); namely, one, two, and three
family residential dwellings within the City limits of Dublin. Said
Board will also have jurisdiction over licensing procedures in
situations where a determination is required in issuing, detaining or
revoking a license.
Section 2. That there is to be a fee of $250.00 to be filed at the
time of the appeal. If that person wins the appeal that sum of
$250.00 will be refunded.
Section 3. The Board shall be established by City Council and shall
consist of five (5) members minimum. The members shall have qualifying
experience and/or training pertaining to residential construction such
as persons trained in mechanical/structural engineering, building,
architecture, etc. All shall be residents of the City of Dublin.
Section 4. Meetings of the Board shall be called by the Chief Building
Official of the City.
Section 5. The decision of the Board shall be reached by a majority of
the Board and shall be final.
Section 6. That this Ordinance shall take effect and be in force from
and after the earliest period allowed by law.
