AN ORDINANCE TO AMEND SECTION 303.99
(a)(4) OF THE CODIFIED ORDINANCES OF
THE CITY OF DUBLIN, OHIO, AND DE-
CLARING AN EMERGENCY
WHEREAS, Section 303.99(a)(4) of the Codified Ordinances of the City
of Dublin, Ohio, does not currently comply with the Ohio Revised Code
and the laws of the State of Ohio, pursuant to the mandatory penalties
for one who violates Section 333.01(a), driving while under the influence
in a Mayor's Court in the State of Ohio;
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin,
State of Ohio, 6 elected members concurring that:
Section 1. Section 303.99(a)(4) is hereby amended as follows:
303.99 TRAFFIC CODE MISDEMEANOR CLASSIFICATION AND PENALTIES
(a) Misdemeanor Classifications
(4) Driving while Intoxicated
Whoever violates Section 333.01(a) is guilty of a mis-
demeanor of the first degree. In addition, said violator
is subject to the license suspension or revocation as
provided in and pursuant to Ohio R.C. 1905.201, 4507.16,
4507.164, 4507.18, Chapter 4509 and 4511.191.
Section 2. This Ordinance is declared to be an emergency necessary for
the immediate preservation of the public health, safety and welfare, and
in order for the City of Dublin to be in compliance with the Ohio law
requiring a Mayor to mandatorily suspend/revoke an offender's operator's
license as penalty for violating Section 0333.01(a), with said law
becoming effective and compliance necessary by October 20, 1987; and
shall take effect and be in force immediately upon passage.
