AN ORDINANCE AUTHORIZING THE
MANAGER TO DECLARE A WATER USE
RESTRICTION, AND DECLARING AN
EMERGENCY
... areas of the City of Dublin are susceptible to
WHEREAS, intermittent
water pressure shortages; and,
WHEREAS, the City of Dublin is currently taking steps in cooperation
with the City of Columbus to remedy these problems; and
WHEREAS, during hot, dry weather it may become necessary to declare a
temporary water use restriction; and
WHEREAS, the ability to promptly impose and enforce such a restriction
is vital to the health, safety and welfare of the residents of the
City of Dublin.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Dublin,
State of Ohio, 7 of the elected members concurring that:
Section 1. "Water Use Restriction", means restriction of use of water
from City lines for a period of time as determined by the City Manager
when there exists insufficient or inadequate water supply or pressure
to provide safe and adequate water service to the City 0f Dublin or
portions thereof.
Section 2. The Manager is hereby authorized to declare a water use
restriction for the entire City or a portion thereof whenever he
determines in his discretion that significant water pressure problems
exist within the City of Dublin or portions thereof, to warrant such
action. Said restriction shall exist from the time it is formally
announced until the time it is formally canceled. Further, a water use
restriction shall be subject to review by Council within seven days of
the issuance thereof.
Section 3. Whenever a water use restriction is declared, the Manager
shall request that the local news media announce the existence of the
restriction, its time of operation and the area in which it will apply.
Cancellation shall be accomplished in the same manner.
Section 4. Whenever a water use restriction is in effect, all forms of
non-essential water use including lawn sprinkling, car washing or uses
specifically set forth by the manager within the water use restriction
shall be prohibited except as said water use comes from a private water
supply.
Section 5. Penalty. Whoever violates this section is guilty of
violating the water use restriction, a minor misdemeanor, with a maximum
fine of one hundred dollars ($100.00) with each day of violation as a
separate offense.
Section 6. That this Ordinance be, and hereby is, declared to be an
emergency measure necessary for the health, safety and welfare of the
public and herefore, this Ordinance shall take effect and be in force
immediately upon its passing.
