AN ORDINANCE AMENDING CHAPTER 1313,
ENTITLED FLOOD CONTROL IN ORDER TO
ACHIEVE COMPLIANCE WITH THE NATIONAL
FLOOD INSURANCE PROGRAM, AND TO DE-
CLARE AN EMERGENCY
WHEREAS, minor changes are necessary in Chapter 1313 of the Dublin
Codified Ordinances to achieve compliance with the National Flood
Insurance Program; and,
WHEREAS, Council has previously adopted Chapter 1313 entitled "Flood
Control", so as to be in compliance with the Federal Emergency Manage-
ment Agency (FEMA).
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin,
State of Ohio, 9 of the elected members concurring that:
Section 1. Section 1313.05(b) is hereby amended to read as follows:
(b) Exemption from filing a development permit. An application
for a development permit shall not be required for maintenance
work such as roofing, painting and basement sealing, or for
small development activities, except for filling and grading,
valued at less than five hundred dollars ($500.00).
Section 2. Section 1313.07(b)(5)C. is hereby amended to read as follows:
C. A determination that the granting of a variance will not
result in increased flood heights beyond that which is
allowed in this ordinance, additional threats to public
safety, extraordinary public expense, create nuisances,
cause fraud on or victimization of the public as determined
in Section 1313.07(a)(4), or conflict with existing local
laws or ordinances.
Section 3. This ordinance is declared to be an emergency necessary for
the immediate preservation of the public's health, safety and welfare for
the reason that compliance with the National Flood Insurance Program is
necessary to insure that the benefits of the program are available to
the citizens of Dublin, and that this ordinance shall take effect and
be in force immediately upon passage.
