WHEREAS, the provisions of the Dublin Planning and Zoning Code require that revision of any portion of a preliminary plan must be approved by the Planning Commission and Council; WHEREAS, the owners of the tract of land known as Indian Run Meadow are revising the approved preliminary development plan to include 22.17 acres of multifamily housing units; NOW, THEREFORE, BE IT ORDAINED by the Council of the Village of Dublin, State of Ohio, ~ of the elected members concurring: Section 1. That the following described real estate (see attached legal description marked Exhibit "A"), situated in the Village of Dublin, State of Ohio, is zoned P.U.D. (Planned Unit Development) and sha II be subject to regulations and procedures contained in Ordinance No. 21-70, (Chapter Eleven of the Codified Ordinances) the Village of Dublin Zoning Code and amendments thereto. Per the ongoing discussions on this property, we have taken the previously proposed twin single units that were to be accessed from the extension of Muirfield Boulevard and have created a specific multi-family area which will have only one access point on the west side of Muirfield Boulevard. As part of our application, we have included actual unit facades and floor plans that will be part of the proposed project and a unit site plan that we will include as commitments as part of the overall zoning process. These units have been specifically created and tailored for this parcel, given the need to maintain consistent design quality along the extension of Muirfield Boulevard and to otherwise reflect a Dublin architectural ethic. Slightly over twenty (20) acres of park area is set aside for the project which may be either publicly dedicated if so required or to be otherwise maintained by a private homeowner's association. The presently zoned eight (8) acre com- mercial center site remains unchanged in both area and location in the amended development plan. D. The proposed provision of water, sanitary sewer and surface drainage facilities including engineering feasibility studies or other evidence of reasonableness: Both sewer and water service have been brought to the site by the applicant which are designed to service a major portion of the property, including the proposed multi-family area. Surface drainage requirements as determined by the V illage of Dublin have been previously planned and partially accommodated in the land area adjacent to the south fork of Indian Run Creek. Additional smaller areas of retention have been proposed as combination retention/entry feature ponds in con- junction with proposed multi family development. E. The proposed traffic circulation patterns including public and private streets and parking areas indicating..... evidence of reasonableness: The amendments to the preliminary development plan bring about an improvement in the overall street network by removing future individual unit curb cuts onto proposed Muirfield Boulevard extension. The planned boulevard will then become more limited access in nature and be able better to service the regional traffic needs of the Dublin northwest quadrant. The boulevard specification also includes an 8' wide bikeway to be built parallel along the eastern edge of the boulevard which is planned to link into a larger bikeway/pedestrian system accommodating proposed projects in the remainder of the northwest quad in looping to and including bikeways along Indian Run Creek over to Coffman Park. The provision of two (2) major east-west collector streets remains unchanged from the presently approved plan. F. The proposed schedule of site development, construction of struc- tures and associated facilities. Such schedules shall include proposed use or reuse of existing features such as topography, structures, streets, easements and natural areas: Development of the site has presently commenced with the first phase of single- family development generally in the southwest corner of the property. Additional single-family phases under presently approved plans will continue as market demand warrants and will generally occur in a north to northeasterly direction. The proposed multi- family area would be commenced immediately upon receiving neces- sary approvals. G. The relationship of the proposed development to existing and future land use in the surrounding area, the street system, community facilities, services and other public improvements: The initial Indian Run Meadow Preliminary Development Plan originally developed in 1976 was the basis for several major planning recom- mendations having direct benefit on the orderly development to the entire northwest quadrant. The concept of Muirfield Boulevard being extended to form a direct tie with the Avery Road freeway interchange, the land set aside for major park areas adjacent to the Indian Run Creek tributaries, and the internal provision for separate pedestrian/bikeway routes have now been fully integrated into all Dublin plans and directions for this area. With over 1096 of the site being dedicated for recreational purposes, with both Avery Park, Coffman Park and the high school readily accessible from the site, and further given the ability to be able to access the regional transportation network easily and conveniently provides the site with an unusual mix of positive attributes and support for develop- ment. H. Space for appropriate council ordinance number approving prelimi- nary development plan: Please see Preliminary Development Plan. ( Minutes of Meeting Planning and Zoning Commission September 5, 1984 Page Eight 8. Amended Preliminary Plan - Indian Run Meadow Subdivision. This is a 198 acre tract located at the northeast corner of Post Road and Avery Road for a 160 unit multifamily housing development. At the time Phase 1 was approved, it was agreed that all of the 116 twin single units that lined the proposed boulevard would be removed and located elsewhere within the subdivision. At this meeting the Commission was to review and recommend on the entire preliminary plan, the multifamily units being one part of the proposa 1. Following are comments made by Mr. Larry Helman and Mr. Al Berthold, the architect. 1. A one entry cut will be on the boulevard - the boulevard being approximately 1400' long) . 2. There will be one major entry. On all other roads there wi II be one major cut on each side; there are two rear access cuts. 3. In all cases the garages are to the rear with an access alley; the fronts of the units have yards. 4. Some units wi II have screened porches. 5. There is a 27 units increase from the original proposal. 6. There are two townhouse type units (of approximately 1200 square ( feet) with finished basements, a bath and a half. One type of townhouse has a formal dining room, the other type has a kitchen/ eating area. 7. The ranch unit: wi II have approximately 1,050 square feet. These units will have no basements. 8. These wi 11 be six unit buildings, of stone and stucco, with 240 lb. asphalt shingle roofs. 9. The end units will have screened-in porches; the middle units will have decks, or vice versa. 10. Each unit will have a fireplace. Mr. Miller had a question regarding the alley access areas, regarding fire and rescue equipment access. It was noted that in front of the units are 26' dedicated public streets. Behind the units are the 20' "alleys"; gradual turns will be put in so that if there was a need for a truck to get back there it could. The hydrants wi II be on the public streets. Mr. Bowman noted that the alley represents a secondary access, if need be, not normally found in most developments. Responding to a question from a resident regarding the school site, the developer responded that the Village wants it, the School Board does not. Mr. Bowman noted that an amended plan is being recommended with regard to to the overall number of acres and the number of dwe II ing unit s that will be in the plan. The vote would be for that plan with the incorporation of multifamily dwelling units. The expectation is that south of Post Road wi 11 be some type of Restricted Industrial development; hopefully, will be major employers; thus the multifamily is appropriately located within the plan. ( Minutes of Meeting Planning and Zoning Commission September 5, 1984 Page Nine Mr. Bowman had some specific comments about the plan itself - 1. That the uses be limited to the permitted uses in Dublin's Neighborhood Commercial District. 2. That the 5.2 acre park be extended north to the proposed east/west street to provide for better access. 3. That all association documents be submitted for the maintenance of all externa I property within the development, and that they be submitted at the time of the final development plan (similar to a condominium) . 4. An emergency access should be provided into the park. 5. There are approximately 360 parking spaces (on street and off street). It would be better to eliminate the "stacking" (one car in front of the other) in the garage areas. 6. Bike paths will be built to Vi llage specifications with a 6' wide landscaped barrier between the path and the road, tying into the boulevard. Mr. Smith said that if the alleys remain private the Association will be responsible for the snow plowing. Mr. Callahan moved to approve the plan. Mrs. Headlee seconded the motion. The vote was 6-0 for approval. 9. Final Development Plan - Muirfield/Day Care. This is a one (1) acre tract located on the west side of Avery Road immediately south of Deer Run School. The existing zoning is P.U.D. The applicants were Jerry and Jennie Walter, with Mr.Larry Caldwell, an architect presenting the plan. Mr. Howard Adams said that Muirfield Ltd. was in favor of the request. The site has been held in reserve for possible use as a middle school, and has recently been released by the school district. Staff indicated support of the plan. Mr. Berlin moved to approve the final development plan with the condition that if the use would change it would go back to P.U.D. and would require a hearing before the Planning and Zoning Commission. Mr. Mi ller seconded the motion. The vote was as follows: Mr. Berlin, yes; Mr. Callahan, yes; Mrs. Headlee, no; Mr. Jezerinac, no; Mr. Macklin, yes; and Mr. Mi ller yes. to.
