Form No. 2806-A Ordinance NO'm__3.Q__8lt__(1\~_ amended) Passed______m_ nun'_..___ ___ .._____ ,___19 AN ORDINANCE REQUIRING BUILDERS AND CONTRACTORS TO REMOVE AND CLEAN FROM ALL STREETS AND PUBLIC HIGH- WAYS, ALL DEBRIS CAUSED BY EXCAVATION, CONSTRUCTION AND OR RELATED TRANSPORTATION. WHEREAS, mud and other debris relating to construction and excavation have been deposited and left on Vi llage streets and highways, and WHEREAS, the Council of the Vi llage has determined that such mud and debris left on Vi llage streets and highways constitutes a danger to the safety, health and welfare of Village residents. NOW, THEREFORE BE IT ORDAINED by the Council of the Village of Dublin, 7 members concurring that: Section 1. When any permit is issued where excavation is required or anticipated, the permit holder shall be totally responsible for the actions of all sub-contractors and workers on the job site and shall be responsible for thoroughly cleaning, on a daily basis, all streets highways or private properties of all mud, earth, rubbish, rocks, refuse or other debris of any kind resulting from such work or related transportation to and from the work site. Section 2. All clean-up operations resulting from such excavation shall be accomplished at the expense of the permit holder and shall be completed to the satisfaction of the Village Engineer or his designated representative. The permit holder shall be given Notice of any infraction and shall be given 24 hours to correct same. Section 3. Failure of the permit holder to make corrections within this 24 hour period sha 11 result in a $100.00 fine. Failure to comply in the specified time on a Second Notice sha 11 result in a fine of $300.00 and, in the event of non-compliance on a Third Notice sha 11 result in a fine of $500.00. Section 4. Any failure to respond to a Third Notice shall be grounds for withdrawing the permit and shutting down the job. Section 5. Unt il any and all fines are satisfied no Certificate of Occupancy shall be issued. Section 6. For the purpose of this section, it shall be presumed, unless otherwise demonstrated by permittee, that any mud, earth, rubbish, rocks, refuse, or other debris of any kind deposited on any street or public highway emanating from any point of entry or exit to or from the work site or within the immediate vicinity of the work site and within the ordinary course of travel of vehicles to and from the work site, originated from or was due to said work or related transportation. .- . That this Ordinance shall take effect and be in force from and after the earliest period allowed by law.
