.~ WHEREAS, the Village of Dublin, Ohio, desires to use the

1 services of the Delaware City Prosecutors to represent them in
~ criminal matters before the Delaware Municipal Court, and

1 WHEREAS, the Council of the City of Delaware is willing to
J provide such services, NOW THEREFORE:

~ BE IT ORDAINED by the Council of the City of Delaware, County

" of Delaware, State of Ohio:

~ SECTION 1. That the City Manager is hereby authorized to enter

, ~ into an agreement with the Village of Dublin to provide the services

,~ of its prosecutors in representing the Village in criminal matters
1 before the Delaware Municipal Court under the following terms and
conditions:

l The Delaware City Prosecutors shall render legal advice

{ to the Village of Dublin and its elected officials and

J shall perform such other duties as are customarily per-
~ formed by one holding such position in other municipalities.

~ b. The term of this agreement shall be for one year commencing

<j December ~985 through December 14. 1986 .

c. The Village shall pay to the City of Delaware the sum of
i
'I Four Hundred Dollars ($400.00) payable in advance.

'.i d. The Village shall reimburse the City for any necessary

1 expenses incurred by the Prosecutors including mileage
~
1 at the rate of $ .20 per mile, but excluding materials,
1 paper and secretarial expenses.
~ e. Either party may terminate the agreement upon thirty
1 (30) days written notice to the other.

j SECTION 2. Emergency Clause. In order to provide for the
protection of the public health, safety and welfare, this Ordinance
is declared to be an emergency measure and shall take effect and be
in force immediately upon its passage.

EMPLOYMENT AGREEMENT
This Agreement is made and entered into this 17th day of December ,
1985, between the City of Delaware, hereinafter called City, and the Village
of Dublin, hereinafter called Village, pursuant to the following terms and
conditions:
l. Nature of Employment:
The Village hereby contracts with the City of Delaware for
the services of its Prosecutors, and the City does hereby
accept and agree thereto. The City agrees that its Prosecutors
shall render legal advice to the Village and its elected
officials and shall perform such other duties as are
customarily performed by one holding such position in other
similar municipalities.
2. Term of Agreement:
The term of this Agreement shall be for one year commencing

3. Payment and Reimbursement:
The Village shall pay the City the sum of Four Hundred Dollars
($400.00) , payable in advance. The Village further agrees that
it will reimburse the City for expenses incurred by its
Prosecutors on behalf of the Village, including mileage at the
rate of $ .20 per mile, but excluding materials, paper and
secretarial expenses which the City agrees to provide at its
own expense.
4. Termination of Agreement:
Notwithstanding anything to the contrary contained in this
Agreement, both parties are hereby given the option to
terminate this Agreement upon thirty (30) days written notice
to the other.
5. Applicable Law:
The parties hereto agree that it is their intention that this
Agreement and the performance hereunder be construed in
accordance with the laws of the State of Ohio.
IN WITNESS WHEREOF, the parties have signed this Agreement on the day
and in the year first above written.
IN WITNESS WHEREOF, the City of Delaware has caused this Agreement to
be signed and executed in its behalf by its City Manager, Jewel D. Scott,
pursuant to Ordinance No. g-S -- g Lj , and the Village of Dublin has caused
