AN ORDINANCE TO AUTHORIZE THE VILLAGE
MANAGER TO ENTER INTO AN AGREEMENT
WITH THE CITY OF DELAWARE, OHIO WITH
RESPECT TO FEES PAID FOR PROSECUTION
OF DUBLIN CASES IN DELAWARE MUNICIPAL
COURT.
WHEREAS, the Village of Dublin desires to use the services of the Delaware
City Prosecutors to represent them in criminal matters before the Delaware
Municipal Court,
WHEREAS, the Council of the City of Delaware is willing to provide such
services,
NOW, THEREFORE, BE IT ORDAINED by the Council of the Village of Dublin,
State of Ohio, 7 of the elected members concurring:
Section 1. That the Village Manager is hereby authorized to enter into an
agreement with the City of Delaware to provide the services of its
prosecutors in representing the Village in criminal matters before the
Delaware Municipal Court under the following terms and conditions:
A. The Delaware City Prosecutors shall render legal advice to
the Village of Dublin and its elected officials and shall
perform such other duties as are customarily performed by
one holding such position in other municipalities.
B. The term of this agreement shall be for one year commencing
December 15, 1985 through December 14, 1986.
C. The Village shall pay to the City of Delaware the sum of Four
Hundred Dollars ($400.00) payable in advance.
D. The Village shall reimburse the City for any necessary expenses
incurred by the Prosecutors including mileage at the rate of
$.20 per mile, but excluding materials, paper and secretarial
expenses.
E. Either party may terminate the agreement upon thirty (30)
days written notice to the other.
Section 2. That this Ordinance is hereby declared to be an emergency
measure necessary for the preservation of the public peace, health and
safety and therefore this Ordinance shall take effect and be in force
immediately upon its passage.
