Form No. 2806-A Ordinance NO'm__~f?~~;?_m.m Passedu____.n.u. un__nn.mnnmm__m__19.m. __ AN ORDINANCE ENACTING SPECIAL LICENSING OF CHILD DAY-CARE CENTERS WITHIN THE VILLAGE OF DUBLIN, OHIO, AND DECLARING AN EMERGENCY. WHEREAS, the Council of the Village of Dublin acknowledges that child day- care centers provide an important and valuable service to the community. WHEREAS, the child day-care industry is continuing to grow, and: WHEREAS, this ordinance constitutes an emergency measure for the immediate preservation of the health, safety and welfare of the citizens of Dublin, such emergency arising from the need to enact and enforce stricter chi ld day-care standards than provided under the Ohio Revised Code. NOW, THEREFORE, BE IT ORDAINED by the Council of the Village of Dublin, 7 members concurring that: Section 1. Definitions). As used in this ordinance, the definitions pro- vided in Ohio Revised Code S5104.01 as enacted or amended are incorporated herein as if fully rewritten. Section 2. License required) . No person, firm, organization, corporation, or agency whether for profit or non-profit shall operate a child day-care center within the Village of Dublin after the effective date of this ordinance, wi thout first obtaining a license. Such license sha 11 be app lied for through the Manager pursuant to Part 7 of the Codified Ordinances of Dublin. The Manager or his agent shall inspect the property to determine if it complies with the provision set forth herein. Section 3. Application) . Any original or renewal application for a license to operate a child day-care center shall be accompanied by a valid state child day-care license or provisional license issued pursuant to Ohio Revised Code S5104.03. Section 4. Minimum requirements). In addition to the provision of appli- cable state law, the following minimum standards must be met: 1. The center has at least two responsible adults available on the premises at all times when five or more children are in the center. The children are organized in small groups and child-care staff provided to give continuity of care and supervision to the children on a day-by-day basis. The maximum number of children per child- care staff member, by age of children is as follows: (1) Under eighteen months . 5 (2) Eighteen months but under three years . 8 (3) Three years but under five years. . .12 (4) Five years and older . . . . .15 Children of the operator and of staff members, who attend the center or are on the premises for supervision and care, are included in the determination of staff requirements and group capacity. 2. Each infant is provided with a separate crib of sturdy construction, with closely spaced bars, a firm mattress securely covered with a waterproof material not dangerous to children, and clean crib sheets. There are no restraining devices of any type used in cribs. The c::= o~ minimum space between cribs is three feet. ~~ 0<1> Section 5. License fee) .
