ORDINANCE NO. 43-85 DETEID1INING TO PROCEED WITH THE CONSTRUCTION OF A TWELVE (12 ) INCH WATER LINE AND APPURTENANCES THERETO ON SHIER-RINGS ROAD FROH THE INTERSECTION OF DUBLIN INDUSTRIAL LANE TO WILCOX ROAD THENCE NORTHERLY ALONG THE EAST SIDE OF WILCOX ROAD APPROXIMATELY SIX HUNDRED (600) FEET IN THE VILLAGE OF DUBLIN, OHIO AND DECLARING AN EHERGENCY. BE IT ORDAINED, by the Council of the Village of Dublin, Franklin, Union and Delaware Counties, Ohio, that: SECTION 1. It is hereby determined to proceed with the construction of a twelve (12 ) inch water line and appurtenances thereto on Shier-Rings Road from the intersection of Dublin Industrial Lane to wilcox Road thence northerly along the east side of Wilcox Road approximately six hundred (600) feet in the Village of Dublin, Ohio. SECTION 2. Said improvements shall be made in accordance with the provisions of Resolution No. 11-85 (the "Resolution of Necessity") duly adopted by this Council on May 13, 1985, and i~ accordance with the plans, specifications, estimates, and profiles heretofore approved and now on file in the office of the Clerk of this Council. SECTION 3. All claims for damages resulting therefrom that have been legally filed shall be inquired into after completion of the improvement. SECTION 4. That portion of the cost of the improvement to be assessed, as set forth in the Resolution of Necessity, shall be assessed in the manner and the number of installments provided in such Resolution and on the lots and lands described therein. SECTION 5. The estimated assessments heretofore prepared and filed in the office of the Clerk of this Council be and the same are hereby adopted. SECTION 6. The Clerk of this Council is hereby directed to deliver a certified copy of this Ordinance to the County Auditors of Franklin, Union and Delaware Counties, Ohio within fifteen (15) days after its passage. SECTION 7. Subject to the provisions of Section 727.24 of the Ohio Revised Code, the City Manager of the Village is hereby authorized and directe~, as soon as the funds therefore are available, to make and execute a contract for the improve- ment with the lowest and best bidder after advertising according to law, and the improvement shall be financed as provided in the Resolution of Necessity. SECTION 8. It is found and determined that all formal actions of this Council concerning and relating to the adoption of this Ordinance were adopted in an open meeting of this Council, and that all deliberations of this Council and of any of its committees that resulted in such formal action, were in meetings open to the public, in compliance with all legal requirements including Section 121.22, Ohio Revised Code. . SECTION 9. This Ordinance is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, health, safety and general welfare of said Village, and for the further reason that preliminary assessment proceedings should be completed at the earliest possible date so that the construction of said improvement can be commenced during favorable weather conditions, and this Ordinance, therefore, shall go into full force and effect immediately upon its passage and publication as provided in the Charter of the Village of Dublin, Ohio.
