ORDINANCE NO. 29-85
l'~N ORDINANCE PROHIBITING IvlANUFACTU RERS, PRODUCERS,
\JHOLESALERS, OR RETAILERS OF CIGARET'rES AND OTHER
TOBACCO PRODUCTS OR THEIR EMPLOYEES OR AGENTS FROt!
DISTRIBUTING CIGARETTES OR OTHER TOBACCO PRODUCTS TO
PERSONS UNDER EIGHTEEN (18 ) YEARS OF AGE.
~lHEREAS , manufacturers, producers, wholesalers or retailers
of cigarettes or other tobacco products or their employees or
agents have distributed cigarettes to persons under the age of
eighteen (18 ) years, and
\'lHEREAS, the Council of the Village has determined that said
distribution of cigarettes or other tobacco products by
manufacturers, producers, wholesalers or retailers or their'
employees or agents to persons under the age of eighteen (18) !
years is a danger to the safety, hea 1 th, and we 1 fare of the
Village residents.
HOH THEREFORE BE IT ORDAINED by Counci 1 of the Vi llage of
Dublin, 5 members concurring that:
Section A. No manufacturer, producer, distributor,
wholesaler or retailer of cigarettes, or other tobacco products,
I or any agent, employee or representative of a manufacturer,
producer, distributor, wholesaler retailer of cigarettes
or or
other tobacco products shall do any of the following:
(1) Give, sell, or otherwise distribute
cigarettes or other tobacco products to any person under
eighteen years of age:
( 2 ) Gi ve away, sell or distribute cigarettes or
other tobacco products in any place that does not have posted in
I a conspicuous place a sign stating that giving, selling, or
otherwise distributing cigarettes or other tobacco products to a
person under eighteen (18) years of age is prohibited by law.
Section B. Whoever violates this section is guilty of
illegal distribution of cigarettes or other tobacco products, a
misdemeanor of the fourth degree. If the offender has
previously been convicted of a violation of this section or Ohio
R. C. 2927.02, then illegal distribution of cigarettes or other

tobacco products is a misdemeanor of the third degree. (ORC

SECTION C. This Ordinance sha 11 take effect and be in
force from and after the earliest period permitted by law.
