AN ORDINANCE TO ACCEPT AN
ANNEXATION OF 109.27! ACRES
IN WASHINGTON TOWNSHIP TO
THE CITY OF DUBLIN -
TUTTLE ROAD AREA
WHEREAS, said annexation has been approved by the Franklin County
Commissioners, and Council is of the opinion that said territory
should be annexed.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin,
State of Ohio, 7 of the elected members concurring:
Section 1. That the petition for the annexation of 109.27~ acres (see
attached legal description) to the City of Dublin, Ohio is hereby
accepted.
Section 2. That this Ordinance shall take effect and be in force from
and after the earliest period allowed by law.

BY LEE R. HEADLEE, ET AL.
FIXED FOR WEDNESDAY, FEBRUARY 3, 1988 AT 10:00 A.M.
CASE 1f63-87
WHEREAS, the Board of County Commissioners of Franklin County, Ohio,
are presented the petition for annexation of certain adjacent territory
to the City of Dub lin, Ohio, filed by Lee R. Headlee, et a1. , signed by
Lee R. Headlee, Barbara Headlee, and Charles P. Driscoll, Vice-President
of Tuttle Road Limited Partnership and appointing Harrison W. Smith, Jr. ,
as agent for the said territory being described as follows:
Situated in the State of Ohio, County of Franklin, Township of
Washington, part of Virginia Military Survey No. 2419, being 109.27 acres
for annexation to the City of Dublin, Ohio, comprised of part of that 42.373
acre tract, part of that 43.459 acre tract and part of that 13.00 acre
tract as described in a deed to Tuttle Road Limited Partnership, of record
in Official Record Volume 08958Hll , part of that 40.311 acre tract as
described in a deed to Lee R. and Barbara Headlee, of record in Deed Book
2842, Page 83, and part of that 4.515 acre tract as described in a deed
to Lee R. and Barbara Headlee, or record in Deed Book 2869, Page 594,
(all references being to records in the Recorder's Office, Franklin County,
Ohio) , said 109.27 acres being more particularly described as follows:
Beginning at the northeasterly corner of said 43.373 acre tract of
land, at the northwesterly corner of the existing City of Dublin Corporation
Line as established by Ordinance No. 49A-80, of record in Official Record
Volume 00505ClO;
Thence South 120 07' 10" East, along the easterly line of said 42.373
acre tract, the westerly line of said Dublin Corporation Line, a distance
of 1243.01 feet to a point of curvature at the northeasterly corner of
that 7.208 acre tract as described in a deed to The Borror Corporation,
of record in Official Record Volume 08984D04 and the northeasterly corner
of the existing City of Dublin Corporation Line as established by Ordinance
No. 34-87;
Thence along the arc of a non-tangent curve to the right, having a
radius of 1,250.00 feet, a central angle of 210 09' 58", an arc distance
'of 461. 77 feet to a point of tangency at the northwesterly corner of said
7.208 acre tract and said Corporation Line, said arc being subtended by
a chord bearing South 890 21' 12" West, a chord distance of 459.15 feet;
Thence South 120 07' 10" East, along the westerly line of said 7.208
acre tract and said Corporation Line, a distance of 703.16 feet to a point;
Thence South 780 55' 46" West, crossing said 42.373 acre tract, into
said 43.459 acre tract, being parallel to and 50.00 feet from (measured
at right angle) the centerline of Tuttle Road, 60.00 feet in width, a
distance of 739.70 feet to an angle point;
Thence South 790 25' 29" West, continuing being parallel to and 50.00
feet from (measured at right angle) the centerline of said Tuttle Road,
crossing said 43.459 acre tract, into said 13.00 acre tract, a distance
of 762.80 feet to a point of curvature;

Thence along the westerly right-of-way line of proposed Parkcenter
Drive, 100.00 feet in width, the following four (4) courses and distances:
1) Along the arc of a non-tangent curve turn out to the left,
having a radius of 35.00 feet, a central angle of 900 00'
00", an arc distance of 54.98 feet to a point of tangency,
said arc being subtended by a chord bearing North 340 25'
29" East, a chord distance of 49.50 feet;
2) North 100 34' 31" West, a distance of 95.00 feet to a point
of curvature.
3) Along the arc of a curve to the left, having a radius of
500.00 feet, a central angle of 200 44' 34", an arc distance
of 181. 02 feet to a point of reverse curvature, said arc
being sub tended by a chord bearing North 200 56' 48" West,
a chord distance of 180.03 feet;
4) Along the arc of a curve to the right, having a radius
of 600.00 feet, a central angle of 510 16' 44", an arc
distance of 536.99 feet to a point, said arc being subtended
by a chord bearing North 50 40' 43" West, a chord distance
of 519.25 feet;
Thence South 860 15 ' 30" West, crossing said 13.00 acre tract, into
said 40.311 acre tract, a distance of 848.50 feet to an angle point;
Thence South 770 07' 11" West, crossing said 40. 311 acre tract and
said 4.515 acre tract, a distance of 401.57 feet to a point in the westerly
I line of said 4.515 acre tract, in the easterly limited access right-of-way
line of Interstate Route 270, in an easterly existing City of Columbus
Corporation Line as established by Ordinance No. 1958-87;
Thence North 120 46' 42" West, along said Corporation Line and said
limited access right-of-way line, a distance of 1131. 33 feet to a point
at the northwesterly corner of said 4.515 acre tract;
Thence North 820 41' 22" East, along the northerly line of said 4.515
I acre tract and said 40.311 acre tract a distance of 995.41 feet to an angle
point;
Thence North 820 21' 53" East, along the northerly line of said 13.00
acre tract, said 43.459 and said 42.373 acre tract, a distance of 2151. 64
feet to the point of beginning and containing 109.27 acres of land to be
annexed to the City of Dublin, Ohio.
WHEREAS, together with a map of said territory accompanying said
petition filed with the Board of County Commissioners, Franklin County,
Ohio, on December 3, 1987, be and the same are hereby filed with the Franklin
, County Zoning Office; now, therefore, upon the motion of Commissioner

BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF FRANKLIN COUNTY,
OHIO:
Section 1. That a hearing upon said petition shall be held

Franklin County Administration Building at 10:00 A.M. on February
3, 1988; and
Section 2. That the Zoning Director to the Board of County
Commissioners be and hereby is directed to notify the agent of
the petitioners of the time and place of said hearing.

WHEREAS, the Commissioners of Franklin County, State of Ohio, proceeding
this day to hear and consider the petition of Lee R. Headlee, et al., filed
December 3, 1987 and having in open hearing heard all of the persons desiring
to be heard for or against the granting of said petition, and having
considered all the facts with reference thereto, and being fully advised,
WHEREAS, find that said petition contains all of the matters required
by law; that the territory sought to be annexed is adjacent and contiguous
to the said City of Dublin, Ohio; that the petition contains a full and
complete description of said territory is accurate; that the petition for
said territory is signed by a majority of the owners of real estate within

TO THE CITY OF Dublin
OF 109.27 ACRES,
MORE OR LESS, IN THE
TOWNSHIP OF Washington
TO THE BOARD OF COUNTY COMMISSIONERS
OF FRANKLIN COUNTY, OHIO:
The undersigned, petitioners in the premises, and being a
MAJORITY OF OWNERS OF REAL ESTATE in the territory hereinctfter
described, consisting of 109.27 acres, more or less, in
the Township of Washinqton , which area is contiguous
and adjacent to the City of Dublin , do hereby pray that
said territory be annexed to the City of Dublin , according ,
to the statutes of the State of Ohio.
A full and accurate description and a plat of said territory
so prayed to be annexed are attached hereto and made part hereof.
In support of said Petition, your petitioners state that there
are within the territory so prayed to be annexed 3 OWNERS
OF REAL ESTATE.
Harrison W. Smith, Jr. , is hereby appointed Agent for the
undersigned Petitioners, as required by Section 709.02 of the

TO SET FORTH A STATEMENT OF MUNICIPAL
SERVICES TO BE PROVIDED TO THE AREA IN
A PROPOSED ANNEXATION OF 109.27! ACRES
FROM WASHINGTON TOWNSHIP-FRANKLIN COUNTY
TO THE CITY OF DUBLIN, OHIO, AS REQUIRED
BY SECTION 709.031 OF THE OHIO REVISED
CODE
WHEREAS, a petition for the annexation of 109.27: acres from Washington
Township was duly filed by Harrison Smith, Jr., the Agent for the
petitioners; and
WHEREAS, a public hearing will be required before the Franklin County
Commissioners; and
WHEREAS, Section 709.031 of the Ohio Revised Code requires that, prior to
said hearing, the Municipal Authority shall adopt a statement indicating
what services, if any, the Municipal Corporation will provide to the
territory proposed for annexation.
NOW, THEREFORE BE IT RESOLVED by the Council of the City of Dublin, State
of Ohio, 7 of the elected members concurring.that:
Section 1. The City of Dublin will provide the following municipal
services fo~ the 109.27~ acres in Washington Township-Franklin County
upon the annexation of said area to the City of Dublin, Ohio:
POLICE The City provides Police service on a full twenty-four hour basis
and communications1are contracted from Perry Township. The City also
has mutual aid agreements with other municipalities.

FIRE_ Fire protection is currently provided by well-staffed departments
in Washington and Perry Townships in Franklin County and Concord Township
in Delaware County. They too have mutual aid agreements with other
municipalities.

SANITATION Residential refuse collection services are contracted by the
City and would be available.
STREET MAINTENANCE The City has a Street Maintenance Department which
provides excellent service in the area of street and road maintenance.
Section 2. The City has SEWER and WATER service area contracts with the
City of Columbus and the subject property is within said service areas,
and conditioned on the ability of the City of Columbus to provide WATER,
and to provide sufficient SEWERAGE disposal capacity, the City will have
the ability to service the area.
Section 3. That this Resolution shall take effect and be in force from
and after the earliest period allowed by law.

Dear Mr. Smith:
Enclosed is a copy of the resolution adopted on December 22, 1987, by the
Board of County Commissioners, setting the time and place of public hearing
for the annexation petition which you, as agent, filed with this office
on December 3, 1987.
Under the provisions of Section 709.03 and 709.031 of the Ohio Revised
Code, you, as agent, are responsible for the following:
(1) Notification of the date of filing of your petition with the Board
of County Commissioners to be delivered to the Clerk of the
municipality to which annexation is proposed and the clerk of
each township which is included in the annexation. (A map,
description and a copy of the petition should be presented to
each clerk).
(2) Publication of the substance of the petition once a week for four
consecutive weeks in a newspaper of general circulation in the
County. (The enclosed resolution will satisfy the statutory
requirements and should be used for the published notice).
(3) Service upon the municipal and township clerks of a copy of the
notice within seven (7) days after the Franklin County Commissioners
set the date for the public hearing on the annexation petition,
is before December 29, 1987.
(4) Preparation of an affidavit stating the name of the agent, the
number of owners of real estate at the time of the filing of
petition and the number of owners signing the petition.
(5) Ensuring that the legislative body of the municipality to which
the annexation is proposed, by ordinance or resolution, adopts
a statement indicating what services, if any, the municipal
corporation will provide to the territory proposed for annexation,
upon annexation.
Proof of compliance with the above is required to be submitted to this
office no later than January 27, 1988.

COUNTY OF FRANKLIN, SS:
Harrison W. Smith, Jr. , being first duly sworn, deposes
and says that he is the Agent for the Petitioners in that
certain Annexation Petition wherein it is prayed that 109.27
acres, more or less, in Washington Township be annexed to
Dublin
the City of ~MI~~, Ohio, which petition is set for hearing
before the Board of County Commissioners of Franklin County,
Ohio, on Wednesday, February 3 19 88 , at 10:00 A.M.; that,
at the time of the filing of said petition, there were 3
owners of real estate in the area so prayed to be annexed,
of which 3 owners 3 had signed and affixed their
signatures to said petition; that affiant was the circulator
of said petition and that, to the best of affiant's knowledge,
each of said signers placed his and/or her name thereon as
his and/or her free and voluntary act and deed; and further
