AN ORDINANCE TO ADOPT THE PROCEDURE AUTHORIZED UNDER OHIO
R.C. 3929.86 TO ENABLE THE MUNICIPALITY TO RECEIVE INSURANCE
PROCEEDS PS SECURITY FOR THE REPAIR OR REMOVAL OF FIRE
DAMAGED STRUCTURES AND DECLARING AN EMERGENCY.
WHEREAS, Ohio R.C. 3929.86 (Am. Sub. S.B. 198, effective July 31, 1980)
authorizes municipalities to receive funds from insurance companies doing
business in the State as security for the repair, removal or securing of
fire damaged structures;
WHEREPS, Ohio R.C. 3929.86 requires municipalities to adopt an
ordinance, resolution or regulation authorizing the implementation of such
procedure and the filing of a certified copy of the enactment with the State
Superintendent of Insurance; now therefore,
BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF DUBLIN, STATE OF OHIO:
Section 1. That a new Section of the Codified Ordinances is hereby
enacted to read as follows:
FI RE DAMAGED STRUCTURES: REMOVAL OR REPAIR SECURING FUND.
The Municipality hereby authorizes the procedure described in Ohio R.C.
3929.86(C) and (D) to be implemented whereby no insurance company doing
business in the State shall pay a claim of a named insured for fire damage to a
structure located within this Municipality unless the applicable provisions of
Ohio R.C. 3929.86 are fully complied with. The Fire Chief of the Washington
Township Fire Department is hereby designated as the officer authorized to
carry out the duties of Ohio R.C. 3929.86. The Clerk of Council shall file
a certified copy of this section with the State Superintendent of Insurance.
Section 2. That this Ordinance is hereby declared to be an emergency
measure necessary for the preservation of the public peace, health, welfare
and safety for the reason that it is imperative to minimize the expenditure
of municipal funds to abate public nuisances occasioned by fire damaged
structures, and shall go into effect at the earliest time allowed by law.
