O. ~ Form No. 2806-A ------ Ordinance No. 0.":::8_9_( Revi sed) P assed___ 00__00000000 n _m__m_mm ______ __19 __m _ ~ AN ORDINANCE AUTHORIZING THE CITY MANAGER AND FINANCE DIRECTOR TO ENTER INTO AN AGREEMENT WITH THE BOARD OF TRUSTEES OF WASHINGTON TOWNSHIP, FRANKLIN COUNTY, OHIO FOR THE CITY OF DUBLIN TO PROVIDE COMMUNICATION SERVICES NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, 7 of the elected members concurring: Section 1. That in consideration of exclusive use of all Washington Township applicable 9-1-1 emergency dispatch equipment by Dublin, Ohio, the City of Dublin agrees to provide communication service twenty-four (24) hours per day and seven (7) days per week to the Fire Department of the Township of Washington, Franklin County, Ohio. Section 2. That terms of said agreement are attached hereto as Exhibit "A". Section 3. That this Ordinance be, and the same hereby is, declared to be an emergency measure necessary for the immediate preservation of the public health, safety and welfare and for further reason that the necessary equipment needs to be ordered, and therefore, this Ordinance shall take effect and be enforced immediately upon passing. In consideration of Washington providing to Dublin the exclusive use of all applicable 9-1-1 emergency dispatch equipment which is currently owned by Washington, Dublin agrees to provide communication services twenty-four (24) hours per day and seven (7) days per week to the Fire Department of the Township of Washington, Ohio. 2. It is mutually agreed by the parties as follows: (a) Dublin shall, at its cost, install and maintain a fire phone in the Dublin Police Division during the period of this contract. (b) Dublin shall answer such phone and shall communicate the message or request to the Washington Township Fire Department in accordance with generally acceptable procedures for dispatching and in accordance with such procedures as shall from time to time be prescribed by the Washington Township Fire Chief. (c) Dublin shall answer the Washington Township Fire radio and shall communicate messages and requests in accordance with generally acceptable dispatching procedures and in accord- ance with such procedures as shall from time to time be prescribed by the Washington Township Fire Chief. (d) Dublin shall keep a log of all communications referred to in Paragraphs (b) and (c) above. Such log and all other papers and information relating to the operation of the Washington Township Fire Department shall be maintained by Dublin and transferred to the Washington Township Fire Department in accordance with procedures prescribed by the -- Washington Township Fire Department. The Dublin d~ patchers shall not release or divulge any information relating to Washington Township Fire operations to persons other than officials of Washington Township Fire Department except as necessitated by generally acceptable dispatching procedures. (e) Dispatching shall be performed only by qualified individ- uals hired by Dublin for that purpose. (f) Dublin shall perform all of its obligations under this contract in accordance with procedures set forth by the Washington Township Fire Chief and shall in no way inter- fere with the operation of the Washington Township Fire Department. (g) Washington shall pay a share of the full cost of all related computer hardware and software, such cost to be as mutually agreed based on the ratio of benefits to each of the two users. Such costs shall include all required upgrades in Dublin's computer hardware to accommodate the extra software and related data so as to minimize any negative effects on Police/Court operations. (h) In the event that the Washington workload necessitates the hiring of a sixth dispatcher during the initial contract period, Washington shall pay all direct and indirect costs of such personnel. This additional dispatcher shall be available for clerical duties as assigned by Washington. Their primary job description would be "dispatcher", however, any ancillary assignments shall be primarily Washington, and secondarily Dublin. (i) Washington shall assume all responsibility for their mobile radio equipment and shall pay any expenses required to render it compatible to the Dublin dispatch center. (j) All maintenance expenses for the central dispatch computer and radio equipment shall be the responsibility of Dublin. (k) All maintenance expenses for Washington's computer and fire dispatch equipment shall be the responsibility of Washington. This Agreement shall become effective June 1, 1989, and shall remain in force for a period of three (3) years. In the event that a merger of the two jurisdictions has not been undertaken during the initial contract period, it is the intention of both parties to negotiate a contract fee during the final year of this contract period to cover an additional three year contract period.
