RECORD OF ORDINANCES National Graphics Corp" Cols,. 0, ~ Form No, 2806,A Ordinance NO'n _~~~__~~mmn Passedm_________nm_mmuu__n_ m__mm_19__m --- Page Two (b) If the City Manager or his designee determines after an investiga- tion that the information furnished under the requirements set forth herein is correct, that the applicant proposes to engage in lawful, seasonal business enterprises and that the site and location for the operation of said business is in compliance with the Municipal- ity's zoning regulations and the site requirement set forth herein, he shall issue a license to the applicant. Section 5. LICENSE FEES AND TERMS. The license fee charged by the City Manager for the license required by this Chapter shall be one dollar ( $1. 00 ) per day and any such license issued shall contain a specific expiration date of 40 consecutive days per product per calendar year. Section 6. BOND, Before any license, as provided by this Ordinance, sha 11 be issued for operation of a seasonal business, as defined herein, the applicant shall file with the City Manager a bond running to the City of Dublin in the amount of five hundred dollars ($500.00) executed by the applicant, as principle, said bond to be approved by the City Attorne-, conditioned that said applicant shall comply fully with all the provisionE of the ordinances of the City of Dublin and statutes of the State of Ohio regulating and concerning the sale of goods, wares and merchandise and will pay all judgments rendered against said applicant for any violation of said ordinances or statutes, Further, the foregoing bond shall also be conditioned upon the applicant's cleaning and restoring the subject site to its original condition prior to the issuance of said application pursuant to the provisions of this Ordinance. Such bond must be approved by the City Attorney, both as to form, and as to responsibilities of the sureties thereon. Section 7. APPEALS. Any applicant who has applied for a license in ac- cordance with this Chapter and to whom the City Manager or his designee has, after an investigation, denied a license may appeal to Council, Notice of such appeal should be filed with the Clerk within five days after the denial by the City Manager or his designee, Such appeal shall be heard by Council at the next regular meeting and its decision shall be final. Section 8. DISPLAY OF LICENSE. The license issued under the provisions of this Chapter shall be displayed in a conspicuous place at all times during the operation of the seasonal business on the approved site. Section 9, OUTDOOR SITE REQUIREMENTS, No license sha 11 be issued for a seasonal business operation at an outdoor site unless the outdoor site is located within a commercial district and meets the following requirements, (1) The proposed outdoor site provides a parking area entirely on asphalt or cement foundation; (2) The outdoor site provides safe and controlled access for both pedestrian and vehicular traffic; (3) The outdoor site is equipped with safe and adequate electrical facilities and lighting for night operations; (4) All other applicable provisions of the Dublin Codified Ordinances, including but not limited to Chapter 1189 "Signs" are complied with; (5) Within seventy-two hours (72 ) of the earlier of either the expiration of the seasonal license or the cessation of business on an outdoor site, the applicant shall cause the site to be returned to its original condition including but not limited to the removal of all seasonal sales related items, fixtures, equipment and litter. The failure to do so will constitute grounds for forfeiture of the bond and denial of additional seasonal business licenses. RECORD OF ORDINANCES . National Graphics Corp,. Any license issued under the provisions of this Chapter may be revoked at any time by the City Manager if the licensee is guilty of fraud, misrepresentation, or any unlawful act in connection with the business, or if the licensee violates any provisions of this Chapter. Section 11. PENALTY, Whoever violates any provision of this Chapter sha 1 be fined not more than one hundred dollars ($100.00) each day during which seasonal business sales or activities in violation of this Chapter shall constitute a separate offense, Section 12. This Ordinance is declared to be an emergency necessary for the immediately preservation of the public health, safety and welfare and shall take effect and be enforced immediately upon passing.
