109-88 Ordinance , " RECORD OF ORDINANCES National Graphics Corp" Cols" 0, ~ Form No, 2806,A Ordinance N 0 ,___~()_9=-~~u_(:^mended) P assed__________ _____________________________________19_____.__ AN ORDINANCE AMENDING SECTION 509.08 (MINOR'S CURFEW) OF THE CODIFIED ORDINANCES OF THE CITY OF DUBLIN, OHIO WHEREAS, the Chief of Police has recommended that the Minor's Curfew Ordinance be modified to provide a 12:00 a.m.-midnight curfew for minors between the ages of 13 and 17 years of age and an after 9:00 p,m, curfew for minors under the age of 13 during the school calendar year (in lu- ding Sundays and holidays) and an after 10:00 p.m. curfew during the time of the year not within the school calendar year, NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, 6 of the elected members concurring that: - Section 1. Section S09.08(a), (b) and (c) (minor's curfew) are hereby amended as follows: (a) No minor under the age of thirteen (13) years shall loiter, idle, wander, stroll, or play in or upon the public streets or public places, places of amusement or entertainment, vacant lots, or other unsupervised places during the period after 9:00 p.m. during the school calendar year (including Sundays and holidays) and after 10:00 p.m. during the time of the year not within the school school calendar year, (b) No minor between the ages of thirteen (13) through seventeen (17) years shall loiter, idle, wander, stroll or play in or upon the public streets or other places, places of amusement and enter- tainment, vacant lots or unsupervised places between the hours of 12:00 a.m.-midnight and 4:30 a.m. the following day. (c) The provisions of this section do not apply to a minor accompanied by his parent, guardian or an adult person made responsible for the child by the parent, or where the minor is upon an emergency errand or legitimate business directed by his or her parent, guardian, or other adult person made responsible for the child by the parent. Section 2. Cols,. 0, ~ Form No, 2806,A Ordinance No, ----11O-88-{Amended) Passed________________ __________________ - _________19_______ AN ORDINANCE DEFINING, REGULATING, AND LICENSING SEASONAL BUSINESS; PROVIDING PENALTIES FOR THE VIOLA- TION THEREOF, AND DECLARING AN EMERGENCY WHEREAS, seasonal businesses are not adequately provided for within the Dublin Planning and Zoning Code; and, WHEREAS, it is in the best interests of the citizens of the City of Dublin to license and regulate seasonal business; and WHEREAS, the operation of a seasonal business may constitute an eyesore, nuisance and/or safety hazard, detrimental to the health, safety and welfare of the residents of the City of Dublin. NOW, THEREFORE BE IT ORDAINED by the Council of the City of Dublin, State of Ohio 7 of the elected members concurring that: - Section 1. AUTHORIZATION, Seasonal uses are permitted only as expressly provided in this Ordinance and shall comply with the requirements of the Codified Ordinances of the City of Dublin, Ohio. Section 2, PERMITTED SEASONAL USES. The following are seasonal uses which are subject to the following specific regulations and standards, in addition to the requirements specified in this Ordinance. 1. Display and open lot sales of Christmas Trees. 2. Display and open lot sales of Pumpkins, Section 3. LICENSE REQUIRED. No person, firm or corporation shall engagE in the business or activity of operating a seasonal business in this Municipality without first obtaining a license and posting a bond as provided in this Chapter. Section 4, LICENSE APPLICATION AND REQUIREMENTS. (a) Application for licenses for seasonal business operation shall be filed with the City Manager or his designee on a form to be furnished by the Municipality, which shall require, at least the following information: (1) The name or names of the person or persons having the manage- ment or supervision of the applicant's business during the time that it is proposed to be carried out in the Municipality; (2) The local address or addresses of such person or persons while engaged in such business; (3) The permanent address or addresses of such person or persons; (4 ) The capacity in which such person or persons will act (that is, whether, as proprietor, agent or otherwise); (5) The name and address of firm or corporation or whose account the business will be carried on, if any; and if a corporation under the laws of what state the same is incorporated; (6) The place or places within the Municipality where it is proposed to carryon the applicant's business, and the length of time during which it is proposed that the business shall be conducted (7) A sketch or site plan showing the actual location on the lot or site, or portion thereof, where the seasonal business shall be conducted, and a statement by the applicant indicating compliance with the site requirements set forth herein.
