Cola., o. ~ Form No. aaoe-A Ordinance NO.mmS_~:__SJ_ P assedm__m__d____mmmm____________"~_~_____J 9-.---,-- AN ORDINANCE TO REPEAL ORDINANCE NO. 61-77 AND ALL AMEND- MENTS THERETO (ORDINANCES NO. 96-79 AND 80-80) AND TO ADOPT IN LIEU THEREOF A NEW COMPENSATION PLAN FOR THE CLASSIFIED EMPLOYEES OF THE VILLAGE OF DUBLIN. I WHEREAS, the Council has determined, upon the Manager's recommendation, that it would be desirable to revise and update the Compensation Plan with the express intent of upgrading the compensatory factors associated with Village employment; and WHEREAS, Council believes that such action will assist in employee recruit- ment efforts, as well as in retention of efficient, effective, productive employees; NOW, THEREFORE, BE IT ORDAINED by the Council of the Village of Dublin, State of Ohio, of the elected members concurring: SECTION 1. That the sections which follow shall hereby constitute the Village of Dublin's Compensation Plan. This Plan supercedes all previously enacted legislation relating to compensation and other factors as set forth in this Plan. This Plan shall be administered and maintained by the Manager, or his designee(s), in concert with the provi~ions of the Charter ,and the Code of Personnel Practices and Procedures (Ordinance No. 03-80), hereafter refer- red to as the "Personnel Code". SECTION 2. HOURS Of WORK/OVERTIME A. The normal work week for all full-time employees shall be forty (40) I hours per week. B. In the event a classified employee is required to work in excess of forty (40) hours per week, that employee shall: 1. be paid an amount equal to 150% of his/her standard rate of pay for . all such excess hours worked, or 2. the Manager may grant compensatory time off with pay - the amount so granted shall be equal to the amount in excess of forty (40) hours. C. In converting annual salaries to standard rates of pay (i.e. hourly rates) full-time employment shall be considered as 2,080 hours per calendar year. SECTION 3. HOLIDAYS A. All classified employees shall receive one (1) full day's pay and time off (i. e. 8 hours) for holidays which are observed by the Village and which are: New Year's Day (January 1) Washington's:Birthday (3rd Monday in February) Memorial Day (4th Monday in May) Independence Day (July 4) Labor Day (First Monday in September) Columbus Day (2nd Monday in October) Veterans' Day (November 11) -I Thanksgiving Day (4th Thursday in November) Christmas Day (December 25) B. In the event that the Federal and/or State government(s) shall ~~signate a specific day of the week or a specific date for any of the aforesaid holidays, then Village holidays will be observed in accordance with said designation. iL "i" " " f ... In the event that any of the aforesaid holidays should fall on a Saturday, the Friday immediately preceding shall be observed as the holiday. In the event that any of the aforesaid holidays should fall on a Sunday, the Monday immediately succeeding shall be observed as the holiday. D. In the event that any of the aforesaid holidays should fall on an employ- ee's regularly scheduled day off, said employee shall be entitled to an addi- tional day off, with pay, provided that: 1. the employee coordinates this additional day off with his/her Department Head; 2. this additional day off is taken within the pay period in which the holiday occurs, barring emergency situations, in which case variances from this requirement may be granted at the Manager's discretion. E. In the event that any employee is required to work on any of the aforesaid holidays, that employee will be compensated for such holiday work at a rate double (200%) his/her standard rate of pay. SECTION 4. SICK LEAVE A. All classified employees shall be entitled to sick leave with pay for those reasons listed in the Personnel Code, Section 8.04 and as per the govern I ing procedures set forth in the aforesaid section. B. Sick leave shall accrue at the rate of one and one-half (1.5) work days (i.e. 12 hours) per month of service with the Village. C. An employee shall not earn sick leave for any month unless he/she is in full pay status for that month, i.e. on duty or on approved leave for at least twenty (20) work days during said monthly period. D. If any employee fails to submit adequate proof of illness, injury or death when requested by the Village under the provisions of the Personnel Code; or in the event that such proof is submitted but does'not provide satisfactory evidence, such leave shall be considered unauthorized leave and shall be with- out pay. E. Maximum accumulation of sick leave shall be two hundred sixty (260) days (i.e. 2,080 hours). F. Upon retirement or layoff, and after at least ten (10) full years (i.e. 120 months) of continuous service with the Village, all classified employees may be paid for accumulated sick leave. The rate of pay for such accumulated sick leave shall be at a rate equal to the employee's last standard rate of pay multiplied by one-third (1/3) of the total number of accumulated sick leave days. Total payment under this provision shall not exceed sixty (60) paid days. I SECTION 5. ANNUAL LEAVE A. Use of annual leave prior to completion of the one (1) year probationary period and the procedures governing the use and approval of such leave are covered in the Personnel Code, Section 8.03. C. Annual leave accrued in anyone year of service shall be used within twelve (12) months following the crediting of same. If not utilized within said time period, and unless the employee has received written approval from the Manager to extend the accrued leave beyond the aforesaid twelve month limitation, the employee will be deemed to have waived said annual leave. D. All classified employees are encouraged to utilize this benefit for the purpose for which it is intended - e.g. rest, relaxation, travel, etc. There- fore, payment for accumulated leave in lieu of actual use will not be approved except when the employee terminates employment. E. The administration shall determine the method of crediting annual leave. SECTION 6. MEDICAL/HOSPITALIZATION BENEFITS A. The Manager may, when he deems it to be desirable or necessary, recommend to Council that additions, deletions or modifications to any of the foregoing benefits are in order. These additions, deletions or modifications may affect the entire Village employee group, or may apply to a particular class of em- ployees. Such additional benefits as may be approved by Council, shall be I provided upon the terms, conditions and requirements which Council establishes ------ SECTI ON 8. SALARY PLAN/PERFORMANCE EVALUATIONS A. All salaried employees shall be paid in semi-monthly installments on the fifteenth (15th) and last day of each month. B. The following "Step Plan" shall be implemented commencing January 1, 1982 for all classified employees who were in Village service prior to March 1, 1981 : - Effective 1/1/82 - a 6.5% automatic increase over 12/31/81 salary - Effective 1/1/83 - a 6.5% automatic increase over 12/31/82 salary - Effective 1/1/84 -a 6.5% automatic increase over 12/31/83 salary C. The following "Step Plan" shall be utilized for all classi fied employees commencing employment after March 1, 1981: - After 1 year's service a 6% automatic increase - After 2 year's service a 6% automatic increase - After 3 year's service a 6% automatic increase D. In both Band C above, when said "Step Plan" expires, all salary increases shall thereafter be granted by the Manager on the basis of merit as determined by the employee's most recent Performance Evaluation Report and shall range I from HI - 14:~~. Performance Evaluation Reports shall be prepared for each classified em- ployee under the provisions of the Personnel Code, Section 8.2 and shall be completed semi-annually. In addition to utilizing the data derived from these evaluations, when granting "merit" increases the Manager shall also con- sider the following factors: 1. The financial position and policies of the Village. 2. Local, regional and national economic conditions. 3. Other relevant factors as determined by the Council and the Manager. G. None of the foregoing provisions shall prohibit the Manager from granting increases in pay to either (1) employees who have yet to complete their one (1) year probationary period, or (2) employees who are deserving of a mid-year salary increase, provided: 1. That in either case such increases are predicated upon superior, ~ plary job performance as determined by a recent Performance Evalua- tion Report and other evidence. 2. The annual budget and appropriations and the Village's financial situation can support these increases. H. The starting annual rate of pay shall be the minimum rate shown in the pay ranges below, unless the Manager renders written approval to start the employee at a rate higher than the minimum and notifies and Finance Director I and Personnel Director of same. No starting rate shall be higher than the maximum rate shown in the ranges below. The maximum rate shall remain in effect until such time as amended by Council. As economic and recruiting conditions warrant, however, the Manager may in- , crease the minimum rates (starting rates) by notifying Council of same in wri ting . Unless Council by motion and majority vote overrules such action within 30 days the new minimum rates established by the Manager shall remain in effect. I. As new job titles and classifications are established, this Compensation Plan shall be adjusted and amended to include appropriate salary ranges for same. K. For all part-time employees/seasonal employees the Manager shall set their salaries with the minimum being the prevailing Federal minimum wage. SECTION 9. This Ordinance shall take effect and be in force from and after the earliest period allowed by law. Passed this 1~ day of _ IJ~~ , 1981.
