34-81 Ordinance . , f! ... " ; ORDINANCE NO. gLj- <2/ i AN ORDINANCE PROVIDING FOR THE SUBMISSION ! TO THE ELECTORATE OF AN AMENDMENT TO SECTION 4.11 OF THE CHARTER OF THE VILLAGE i OF DUBLIN AND DECLARING AN EMERGENCY. I I I BE IT ORDAINED by the Council of the Village of Dublin, I ; Counties of Franklin and Delaware, State of Ohio, two-thirds of the members elected thereto concurring: Section 1. That the question of the Amendment of Article IV, , i Section 4.11 of the Charter of the Village, so that as amended the same shall be and read as follows: 4.11. ZONING MEASURES. (a) Ordinances and resolutions establishing, amending, revising, changing or repealing zoning classifications, districts, uses or regulations shall be introduced by a member of Council after submission by the applicant in accordance with the Zoning I Code, of a duly completed application for the zoning establishment, I amendment, change, repeal or revision desired or by Council, on .....' I its own initiative for such changes as may be necessary in th~ ~'~....... public interest. Immediately after the first reading of the ,- ordinance or resolution, the proposed ordinance or resolution {" shall be submitted to the Planning and Zoning Commission for consideration at the next regular meeting of the Commission which occurs not less than seven (7) days following the first reading of the ordinance or resolution. The Chairman of the Planning and. Zoning Commission shall make certain that the proposed ordinance I or resolution is placed on the agenda for such meeting as specifie or at the next special or regular meeting called for such purposes. I I The Planning and Zoning Commission shall, by a roll 1 I call vote, authorize the Secretary of the Commission to issue a ~~i written notice of the Commission's recommendations to the Clerk i Council. Such recommendations shall be ,I submitted to the Clerk of Council as soon as practicable but in no event later than sixty (60) days after referral from Council unless such longer period is first agreed to in writing by the applicant or his representative or extended by approval of a majority of the members of the Commission. Immediately after receipt of the recommendations of I the Planning and Zoning Commission or in the event no recommenda- tions are received by sixty (60) days from the date of first referral of the ordinance or resolution to the Planning and Zoning Co~aission without extension of the sixty (60) day period by said Commission, the Clerk of Council shall cause a notice of public hearing to be published one time in a newspaper of general circulation within the Municipality, said publication to be made I at least seven (7) days prior to the date of the public hearing. Such .public hearing shall also constitute the second reading I of the proposed ordinance or resolution. The Clerk of Council shall cause to be mailed by certified mail,with return receipt, written notice of the hearing to the owners of the property within, contiguous to and directly across the street from the affected parcel or parcels. Such notices shall be sent to the addresses of owners appearing on the County Auditor's current tax list and on other lists as may be required by Council. The failure of delivery of the notice shall not invalidate any ordinance or resolution. (b) A concurring vote of at least two-thirds of the I membership of Council shall be necessary to pass any zoning ordinance or resolution which differs from the written recommenda- tions of the Planning and Zoning Commission, but in no event shall an ordinance or resolution be considered as having passed unless it receives at least a majority vote of the members of Council. That the ballots for said election shall, at the top thereof, be entitled, "Village Charter Amendment Ballot", I and the question to be submitted on said ballot shall be in words following: "Shall the proposed amendment of Article IV, Section 4.11 of the Charter of the Village of Dublin (followed by the text thereof as set forth in Section 1, above) be adopted?" To the left of said wording, in boxes, with the appropriate place for marking, shall appear the words, "Yes" and "No", and each voter shall indicate his vote by making a cross mark with a black lead pencil in the place so provided. Section 3. That public notice of the time and place of holding such election shall be given by publication of notice thereof at least ten (10) days prior to the day of such election, in a newspaper published and of general circulation in the I Village. Section 4. That the Clerk of Council be and ~ereby is directed to mail a copy of the above proposed Charter Amendment to each elector whose name appears upon the registration books of the last regular election held in the Village, at least thirty (30) days before the date of such election, and to certify a copy of this Ordinance to the Board of Elections of Franklin '. and Delaware Counties. Section 5. That to pay the cost of printing and mailing said copies of said proposed Charter Amendment and of publishing said notice there be and there is hereby appropriated from the I I General Fund the sum of $ / ~ tJO. 00 , or so much thereof as ... , may be needed. Section 6. That this Ordinance be and the same hereby is declared to be an emergency measure necessary for the immediate preservation of the public health, safety, and welfare; therefore, this 'Ordinance shall take effect and be in force immediately upon its passage. . .- . .
