Ordinance 61-12RECORD OF ORDINANCES Blank, Inc Ordinance No 61 -12 Passed 20 AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE NECESSARY CONVEYANCE DOCUMENTATION TO ACQUIRE A 0.135 ACRES, MORE OR LESS, FEE SIMPLE INTEREST (WITH 0.082 ACRES AS PRESENT ROAD OCCUPIED), A 0.086 ACRES, MORE OR LESS, FEE SIMPLE INTEREST, AND A 0.046 ACRES, MORE OR LESS, TEMPORARY CONSTRUCTION EASEMENT FROM JUBILEE LP WHEREAS, the City of Dublin ( "City") is preparing to construct the Emerald Parkway Phase 8 Roadway Construction Project ( "Project "); and WHEREAS, Jubilee LP ( "Jubilee ") is the owner of real property ( the "Property") that the City must acquire certain property interests from in order to construct the Project, which are legally described in Exhibit "A" to this Ordinance; and WHEREAS, the City and Jubilee participated in discussions for the acquisition of the Property and have come to mutually agreeable terms for the acquisition; and WHEREAS, the City desires to execute necessary conveyance documentation to complete the transaction between the City and Jubilee. NOW, THEREFO ZE, BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, 1. of the elected members concurring that: Section 1. The City Manager is hereby authorized to execute all necessary conveyance documentation to acquire a 0.135 acre, more or less, fee simple interest (with 0.082 acres as present road occupied); a 0.086 acre, more or less, fee simple interest; and a 0.046 acre, more or less, temporary construction easement from Jubilee LP. Section 2. Jubilee shall be compensated for the aforementioned property interests in the amount of Twelve Thousand Eight Hundred Seventy Dollars ($12,870.00). S ection 3. Haque DATE: September 20, 2012 RE: Ordinance No. 61 -12 Emerald Parkway Phase 8 Jubilee LP PROJECT BACKGROUND: The City of Dublin ("City") is preparing to construct the Emerald Parkway Phase 8 roadway construction project ( "Project's. The City must acquire property interests from various landowners located within the City in order to construct this Project. A representative of the City has reached out to landowners in order to gauge their respective interests in selling the needed property interests to the City. One of the landowners that the City must obtain property from for the construction of the Project is Jubilee LP ( "Jubilee "). After engaging in amicable negotiations, the City has come to an agreement with Jubilee to acquire the necessary property interests pursuant to the terms outlined in this memorandum. ACQUISITION INTRODUCTION: The City will be acquiring from Jubilee only those property interests needed for the Project. These property interests are generally depicted in the map that is attached to this memorandum. The City initially offered $11,700.00 for the property interests needed in accordance with the City's appraisal. After negotiations, the City has agreed to offer and Jubilee has agreed to accept an additional $1,170.00 for the necessary property interests. Accordingly, Jubilee will be compensated $12,870.00 in total for the property. ACTION TO BE AUTHORIZED BY ORDINANCE: Ordinance 61 -12 would allow the City Manager to execute all necessary conveyance documentation to formally acquire the aforementioned property interests.
