LESS, PERMANENT SHARED -USE PATH, DRAINAGE AND GRADING
EASEMENT (RESERVE FFF), A 0.047 ACRES, MORE OR LESS,
TEMPORARY CONSTRUCTION AND GRADING EASEMENT (RESERVE
FFF), AND A 0.025 ACRES, MORE OR LESS, TEMPORARY
CONSTRUCTION AND GRADING EASEMENT FROM THE MUIRFIELD
ASSOCIATION, INC., AND DECLARING AN EMERGENCY.
WHEREAS, the City of Dublin ( "City ") is preparing to construct a shared -use path in
the vicinity of Muirfield Village ('Project'); and
WHEREAS, said project requires that the City obtain certain property interests in
multiple parcels, owned by the Muirfield Association, Inc. (the "Owner "); and
WHEREAS, the Owner is willing to dedicate the necessary property interests to the
City as set forth in the legal descriptions attached hereto, and the City is willing to
accept said dedication.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State
of Ohio, —?— of the elected members concurring that:
Section 1. The City Manager is hereby authorized to execute all documentation
necessary to accept the dedication of a 0.094 acres, more or less, permanent shared -
use path, drainage and grading easement (Reserve III), a 0.004 acres, more or
less, temporary construction and grading easement (Reserve III), a 0.141 acres,
more or less, permanent shared -use path, drainage and grading easement (Reserve
FFF), a 0.047 acres, more or less, temporary construction and grading easement
(Reserve FFF), and a 0.025 acres, more or less, temporary construction and grading
easement from the Owner, as set forth in the legal descriptions attached herewith.
Section 2 . This ordinance is hereby declared to be an emergency necessary for the
immediate preservation of the public health, safety and welfare. The reason for such
necessity is the construction of this shared -use path is necessary to keep cyclists and
pedestrians from traversing on nearby streets whereby health and safety of cyclists and
pedestrians is at risk. Therefore, this ordinance shall go into immediate effect upon
passage.

Glick Road Shared -Use Path, Section 2 — Donation of Easements
Background
The City of Dublin ( "City's is preparing to construct the Glick Road Shared -Use Path, Section 2
( "Project') along the south side of Glick Road from Muirfield Drive to Carnoustie Drive. In locations
where the path is not located within the existing right -of -way of Glick Road, the path will be located
within areas owned by the Muirfield Association, Inc. ( "Association'). As a result, the City must acquire
certain property interests from the Association in order to construct this project. After engaging in very
amicable and supportive discussions, the Association has agreed to dedicate, as a donation, to the City
the necessary Permanent Shared -Use Path, Drainage and Grading Easements ( "Permanent Easement'
and Temporary Construction and Grading Easements ("Temporary Easements'.
Summary
The Association is dedicating to the City the following property interests located within Delaware County
parcel nos. 60034306012000 (Reserve III), 60034127008000 (Reserve FFF), and 60034123001000, as
depicted on the attached descriptions and exhibits, as follows:
• Parcel No. 60034306012000: 0.094 acres Permanent Easement and 0.004 acres Temporary
Easement
Parcel No. 60034127008000: 0.141 acres Permanent Easement and 0.047 acres Temporary
Easement
• Parcel No. 60034123001000: 0.025 acres Temporary Easement
Ordinance No. 52 -12 would allow the City Manager to execute all necessary conveyance documentation
to formally accept the dedication of the aforementioned property interests in the form of permanent and
temporary easements.
Recommendation
Staff recommends approval of Ordinance No. 52 -12 on August 8, 2012, dispensing with the public
hearing and declaring an emergency, as obtaining the property interests described herein is necessary
for the furtherance of the construction of this section of the Glick Road Shared -Use Path, presently being
advertised for bids. Furthermore, staff recommends a letter of appreciation be sent to the Muirfield
Association, Inc. expressing the City's gratitude for this donation of easements.
