Inc. 54 -12 No. Form No.30043 Passed 20 AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE NECESSARY CONVEYANCE DOCUMENTATION FOR THE ACQUISITION OF A 0.784 ACRES (WITH 0.355 ACRES AS PRESENT ROAD OCCUPIED), MORE OR LESS, FEE SIMPLE INTEREST, A 0.195 ACRES, MORE OR LESS, PERMANENT UTILITY AND DRAINAGE EASEMENT, AND A 0.125 ACRES, MORE OR LESS, TEMPORARY CONSTRUCTION EASEMENT FROM ORELLA LYON WHEREAS, the City of Dublin (the "City ") is preparing to construct a roundabout at the intersection of Hyland -Croy Road and Brand Road; and WHEREAS, said roadway project requires that the City obtain certain property interests in Union County Parcel No. 17- 0028018.000, owned by Orella Lyon ( "Lyon "), said property interests set forth in the legal descriptions attached hereto as Exhibits "A "; and WHEREAS, the City and Lyon participated in discussions for the acquisition of this property, and have come to mutually agreeable terms for the acquisition; and WHEREAS, the City desires to execute necessary conveyance documentation to complete the transaction between the City and Lyon. NOW, THERE, BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, of the elected members concurring that: Section I. The City Manager is hereby authorized to execute all necessary conveyance documentation to acquire an approximate 0.784 acre fee simple interest (with 0.355 acres as Present Road Occupied), an approximate 0.195 acre permanent utility and drainage easement, and an approximate 0.125 acre temporary construction and grading easement within Union County Parcel No. 17- 0028018.000, as set forth in the legal descriptions attached, from Orella Lyon. Section 2. Orella Lyon shall be compensated for the aforementioned property interests in the amount of Forty -Seven Thousand Three Hundred Sixty-Three and 00 /100 Dollars ($47,363.00). Section 3. This ordinance shall go into effect as of the earliest date permitted by law. Passed this day of 2012. Haque DATE: September 6, 2012 RE: Ordinance No. 54 -12 Hyland- Croy /Brand Road Roundabout Project Orella Lyon PROJECT BACKGROUND: The City of Dublin ( "City") is preparing to construct a roundabout at the intersection of Hyland - Croy and Brand Roads (the "Project "). The City must obtain property interests from various landowners located within the City in order to construct this project. The City presented good faith offers to each of these landowners in accordance with the Ohio Revised Code. One of the landowners that the City must obtain property from for the construction of the Project is Orella Lyon ( "Lyon "). After engaging in amicable negotiations, the City has come to an agreement with Lyon to acquire the necessary property interests pursuant to the terms outlined in this memorandum. ACQUISITION INTRODUCTION: The City will be acquiring from Lyon only those property interests needed for the roundabout project. These property interests are generally depicted in the map that is attached to this memorandum. The City initially offered $42,363.00 for the property interests needed in accordance with the City's appraisal. After negotiations, the City has agreed to offer, and Lyon has agreed to accept an additional $5,000.00 for the necessary property interests. Accordingly, Lyon will be compensated $47,363.00 in total for the property. ACTION TO BE AUTHORIZED BY ORDINANCE: Ordinance 54 -12 would authorize the City Manager to execute all necessary conveyance documentation to formally acquire the aforementioned property interests.
