AN ORDINANCE DELINEATING PROPER IN- STALLATION OF HEATING STOVES, FREE- I STANDING FIREPLACES, AND PREFABR 1- CATED FIREPLACES, AND REQUIRING A PERMIT AND INSPECTION OF SAME. WHEREAS, the Dublin Village Council is cognizant that owners of existing homes and homes under construction are i nsta II i ng heat- ing stoves, freestanding fireplaces and prefabricated fireplaces to offset increasing home heating costs and/or for decorative/ aesthetic reasons, and WHEREAS, the Vii lage of Dublin currently has no regulations deal- ing with the proper insta"ation of heating stoves, freestanding fireplaces and prefabricated fireplaces and inspection thereof, and WHEREAS, the Dublin Village Council believes that there is a strong and present need for such proper regulations and inspect- Ions; NOW, THEREFORE, BE IT ORDAINED by the Council of the Village of Dub I in, State of Ohio, ~ of the elected members concurring: I SECTION I . That the Directives marked as Exhibit "A" and Exhibit "B" attached hereto, and thereby made a part of this Ordinance, , sha II be implemented and enforced by the Building I nspector under the supervision of the Village Engineer. SECTION 2. That the Building Inspector sha II inspect all free- standing fireplaces, heating stoves and prefabricated fireplaces in newly constructed residences in the Village during the final or occupancy inspect ion. No separate permit or fee is required. SECTION 3. That a Permit must be applied for and received before a freestanding fireplace, heating stove or prefabricated fire- place may be installed in any currently existing residence in the V i II age and an inspection of same shall be performed by the Building Inspector. The Building Inspector sha II dev i se the pro- per application and permit forms. Said Permit shall involve a Fifteen Dollar ($15.00) fee payable upon application. SECTION 4. Freestanding fireplaces and heating stoves shall be in- stalled in compliance with the manufacturer's i nstruct- ions and with the conditions of the appliance listing by Underwriters Laboratory (UL) or other recognized testing laboratory. B. Floor protection shall extend at least 12" beyond the sides and rear and 20" beyend the front. C. Floor protection shall be of approved material equivalent to the following according to the length of the stove legs or the height of the fireplace above the floor. I . 6" to 18": 24 gauge sheet metal laid over a 1/4" sheet of asbestos millboard. 2. 6" or less: 2" to 4" of hollow masonry laid I to provide air circulation a~red with a sheet of 24 gauge sheet metal. D. Provide 24 gauge sheet metal thimble for smoke pipe where required to pass through combustible wall construction. Thimble diameter must be three times the smoke pipe diam- eter. Horizontal section of smoke pipe shall rise 1/4" per foot of pipe. E. Smoke pipe s ha II have the clearances according to the type of protection provided. A circulating stove is one with a sec- I ond meta I jacket enclosing a space for heating and circulating air. 3. A supplemental^heating device is one such as the Add-A-Furnace. G. The clearances indicated herein apply except where the listing of an appliance specifies a greater clearance, in which case the listed clearance will contro I . H. Asbestos millboard referred to herein is a different material from asbestos cement board and asbestos cement- board will not be approved. I . 8" masonry walls or other non-combustible construction require no clearance except for proper operation of the appl iance. I J. Freestanding fireplaces and heating stoves shall be i n- stalled with the clearances from the unprotected or pro- tected combustible materials as herein indicated. I . All clearances should be measured from the outer surface of the appliance to the combustible material disregarding any intervening protection applied to the combustible material. 2. All freestanding fireplaces and heating stoves sha II have 48" clearance in front of app I i ance. . 3. Protective coverings shall extend over all areas of wa II and ceiling to the minimum clearance allowed for an unpro- tected wall, that is 36" for appliance and 18" for stove pipe. a ':" r -4- 4. All fireplaces and heating stoves shall have an approved chimney connection, consisting of the smoke pipe and either an approved prefabricated chimney or a thimble mortared into an acceptable masonry chimney. N. Provide a spark arresting screen and raincap on top of the chimney. O. Only one fireplace or heating stove shall be 'vented into one flue. Only one fuel sha II be connected to a flue. P. The smoke pipe shall not reduce in size from the smoke collar of the stove to the chimney. Q. Do not connect stove vent into an existing masonry chimney unless the chimney is inspected and approved. I R. A II flues sha II have a cleanout below the point of entry of the smoke pipe. In masonry chimneys the distance shall be twelve (12) inches. S. Heat i ng stoves inserted into existing masonry fireplaces cannot be approved unless a positive smoke pipe connection can be made into the exis~ing ~Iue in compliance with ac- cepted engineering practive as per N.F.P.A. NO. 211 "Stand- ard for Chimneys, Fireplaces, and Venting Systems." T. Permits for freestanding fireplaces and heating stoves are issued only to residing homeowners, licensed heating con- tractors, general contractor or builder to whom a building permit is issued or a home improvement contractor. u. Check with your insurance company. Some companies do not wish to insure homes heated by wood, because of the increased fire hazard or may require an inspection by an insurance com- pany representative. ~. .. _u._.' . ...'.~ , . Metal prefabricated factory built fireplaces either free standing or constructed exposed against a wall and installed with a metal flue will be inspected by the building inspector. B. Metal prefabricated factory built fireplaces i n st a I led wit h a metal flue and enclosed into the building with studding shall be inspected by both structural and heating inspectors. The structural inspector sha II inspect the studding framing ad building details. No wood framing shall be within two inches of the back of the fireplace. C. When the bottom of the prefabricated firebox is at a higher elevation than the hearth, the 20" minimum hearth width shall be measured from this edge of the metal fireplace unit. D. The fireplace recess surfaces shall be fire-resistive plaster, masonry or i" fire code gypsum board. The recess covering shall be carried up to the elevation of the connection of the metal flue to the fireplace firebox. Above this elevation the metal flue sha II have the clearance required with its U. l. rat in g, or the building codes. I E. Maximum height of unsupported metal flue or boxed in frame chimney covering metal flue shall be six (6) feet above the supporting roof. Boxed in frame chimneys or metal flues higher that six (6) feet shall be braced as approved by the building inspector. F. Boxed in frame ch.imney covering metal flue shall be provided with a water tight metal cap and necessary flashing collar at metal flue. The metal cap shall be installed to provide drain- age, and slope to the edges of the boxed in frame chimney. G. Gas and electric only fireplaces shall have an approved metal plate so stating, attached to rear of fireplace. H. Fireplace hearth shall be of size indicated in National Fire Protection Association (N.F.P.A.)
