WHEREAS, placing uti lities underground is a positive aesthetic anc environmental procedure and consistent with Dublin's Image. \vHEREAS, there is a desire to prevent housing costs from being further escalated so as to al low for broader housing opportunitie~ within Dublin. WHEREAS, existing subdivision regulations contain no provision for cable television equipment easements. I NOW, THEREFORE, BE IT ORDAINED by the Council of the Vfllage of Dublin, State of Ohio, ~ of the elected members concurring: SECTION I . That Ordinance 19-79 be and hereby is repealed and thst Ordinance No: 27-74, Section 205.09 shall be reenacted to read as follows: 205.09 The location, invert elevation, and size of existing sanitary storm sewers, water mains, cu I verts, street , I ights and other uti lities and underground structures within the tract or immediately adjacent thereto. SECTION 2. The Subdivision Regulations Ordinance No: 27-74 and Section 300 the~eof be and hereby are amended to read: as follows: SECTION 300 SUBDIVISION IMPROVEMENTS The design of all improvements, including grades or streets, type of pavement, drainage, sidewalks, sanitary sewers, st or IT sewers, water distribution facilities, street light ing faci 1- ities and electric, telephone and cable television facil ities sha II conform to the requirements set forth in these regula- I tions. Telephone and Cable Television I --- The installation, construction and expansion of electric, telephone and cable television shal I generaJ Iy be placed underground subject to the following condition and exceptions: 318.01 Transmission lines are exempted from the provisions of Section 318 of the subdivision regulations. Transmission lines are defined as those lines con- structed between generating stations and substations. 318.02 For the standard or typical underground util ity installation that equipment typically placed above ground such as transformers and switches affixed on the ground shall be exempt from the provisions of Section 318 of the subdivision regulations. 318.03 For purposes of this subdivision regulation, under- ground services adjacent to new subdivision, com- mercial and industrial uses shal I include but not be I i m i ted to: 318.031 Overhead wires extending across the public I right-of-way from existing overhead service to such new subdivisions, commercial and industrial uses. 318.032 Adjacent overhead services within the property submitted for subdivision approval that existed prior to the filing of a prel iminary plat. 318.04 Temporary overhead service of electric and tele- phone shajl be allowed, provided that al I perman- I ent electric, telephone and cable television ser- vices within and adjacent to new subdivisions, commercial and industrial uses shal I be underground. 318.041 For the purposes of this subdivision reg- ulation temporary overhead service shall mean: (a) That service which is necessary for immediate publ ic convenience and necessity and is con- structed to serve only on an interim basis until permanent underground services can be installed. I (b) That service which in order to reach a new subdivision, commercial or industrial use must be extended from existing overhead ser- vice through undeveloped parcels of land not included in the subdivisions, commercial or industrial use. , 318.05 The owner or developer of new subdivisions, com- mercial and industrial uses shal I offer an ~asemen for TV cable and TV cable equipment within the easement shown on the plat for electric and tele- phone utilities. The easement shall be granted at no expense to the TV cable operator. 11 .
